Firstly what an amazing forum... (first post!)
I'm not a super regular Merseyflow user - maybe 5 - 6 times a year, so don't have an account, but tend to keep a couple of crossings paid in advance. Just in case. Anyway, for what ever reason, I seem to have attracted a PCN and can't prove that I had paid for this crossing. However the alleged offence was the 15/10/18 and the issue date was 17 /4/19. This seems a long time, so was wondering if like speeding fines the PCN's loose validity after a certain time period. I have uploaded the PCN for reference. Any advice would be much appreciated. Thank you |

Main thing is what does the legislation for Merseyflow say for time to issue a PCN. Nothing that I can see so far in 2013 Regs. Maybe the Mersey Order? -------------------- |

Nothing there either, but still six months seems too long. The cut-off for criminal proceedings is six months, as is the statutory limitation for all PCN schemes that have an explicit limitation period. OP, we very, very rarely see a case where a hiring company does not notify the hiree that they have received a fine for a traffic violation.
So you had no prior notice from the company? In any event, you can fill in the gaps by contacting them to find out when it was received and what they did, including when they received notification that their PCN has been cancelled. Forget the authority, just establish the facts. If you do this promptly you'll still have time to submit reps based on hard facts. |

Yes this is lease car so appreciate there will have been a time delay for issuance here, however would expect this to be no more than 1 month? So this still feels a long time. What would you suggest? |
