Motorway speeding 100mph, Got pulled, little or no info and told to wait for a court summons

Hi all!

I got pulled yesterday on my way home traveling on the motorway at (as I was told by the policeman in question) "in excess of 100mph".

I'm very worried, as due to the fact he didn't produce a yellow pad and give me a ticket etc then said I'd have to go to court has really shaken me up.

When I thought about this driving back after being pulled I was even more worried, as I suddenly realised that I knew nothing about the situation, what had been recorded, what would happen etc.

The officer was alone in an unmarked car when he pulled me, he ran through a few checks on me with the office to prove ID etc. then filled in a two page form before getting me to sign it (I was a little mad with myself after, but at the time was in too much of a state to think about reading it).

I wasn't told the actual speed he'd clocked me at, shown or told of any evidence he had or what the form was for. I'm not shirking this, fact is I was over the limit (full stop!) but I'm very worried about getting a ban or large number of points, as I do have to drive for my job.

Seen some posts where answers have come in asking for 8 or 9 bits of info found on an FAQ but apparently thats down so dont know whats needed so cant give that as yet.

If anyone has any help/advice/info they can give me here it would be appreciated as I am extremely concerned about the situation.

Its very hard to fight a 'pull', you'll have to await the summons and see what the witness statement says and we can progress form there.

As per the advice above, the best thing to do is wait. Not helpful i know but then you can see the exact details and progress from there. I would suggest that when/if you receive a summons you scan it, wash out any personal details and post back on here for some advice.

Although not easy i know, its best not to start panicking just yet. There are many factors that can be considered for mitigation, and previous driving history will also be taken into consideration. Bans can be short ie two weeks, so as some advice was once given to me, best try and save some annual leave for now.

Hi All,

No offence, but was hoping I wouldn't be back here after my little problem way back in July (to be accurate, I got pulled on the 14th July 2007), but got in tonight to find a summons on the doorstep.

The court summons has been dated 25/09/07, and I received it today 16/10/07 and the cout appearance date is the 22/10/07 - Yes, only six days time (5 as of tomorrow morning - 2 of which are weekend days) where I can do something about it - Is it me or is that a little short, and wrong.

I've finally also now seen a copy of the police officers report (which I was not supplied with at the time, nor was I told the speed I'd been clocked at, but this states I was caught on "digital imagery" ref "MGL/1" (dont know if this affects anything, but I wasnt shown this) travelling at 101mph over the distance of 1mile.

The officers report also shows the following statement -

"Speedo checks at speeds of 60mph using stopwatch number V300307-3. Times recorded 60.255 at the measured mile at Clifton M18 RBC Rotherham"

- Again, don't know if this means anything but figured I should add it in as you guys may think this is relevant.

Feel in absolute turmoil right now, as it's been so long since the incident that I wouldn't be able to remember anything about it if I tried! What the hell am I supposed to do? What do I say in court? Roughly how much is the fine likely to be? So many questions and no answers ohmy.gif(

Any help on this would really be appreciated.

Were you doing 101 mph? Do you think you were going slower, albeit in excess of 70 mph? Other people will help out on here on how to argue that although you're guilty, you weren't driving at that speed if you weren't doing 101mph but only, say 90mph. For the avoidance of the misunderstanding of others, I am not suggesting that this was your speed or telling you to protest that your speed was lower if it wasn't - just that if you weren't doing the ton and you know you wasn't, you just might save your licence

So the speedo cal check shows it over reading by 0.4% at 60, certainly enough of an error to query the alleged 101 as being over 100, and its the less scientific follow check rather than Vascar....

I would be inclined to plead guilty to the absolute offence of speeding and request a 'Newton hearing' to contest the actual alleged speed, if you can argue it down to say 95 then your peanlty would be much reduced.
