The court process is that the council will present the matter to court to obtain a "Liability Order". This compels the debtor to pay by order of the court (with the threat - though rarely used - of imprisonment should you fail to comply). If that meets with no success some councils employ bailiffs to try to enforce the debt. Others return the matter directly to court where a "means enquiry" is conducted. Following that the court has the power to remit (i.e. write off) some or all of the debt or to impose a custodial sentence. This is usually suspended on the condition that an agreed payment plan is complied with. If it is not the matter will be returned to court and a custodial sentence can be imposed. It is important to note that, unlike fines, the debt is not written off by the serving of the custodial sentence but remains outstanding.

If you have a reason not to pay, you need to get onto council about it and provide evidence why not.
If it is oversight and you are willing to pay, get onto council and agree a payment plan. If not paying through principle or as a protest....usually ends in tears. Unless it actually gets to a court, the council are the arbiters and the ones you deal with. |

Also claiming that you're not the person mentioned on the paperwork because you claim your name is "James son of Keith" or some variation thereof, rather than your actual name, will never ever work.

At my previous address I always had problems with council tax payments. the system was/is so complicated even the council officials taking me to court for non-payment/under-payments couldn't work out what I should have paid. The cases never got to court as they were baffled about it and could never prove beyond reasonable doubt their case.
If the OP is of limited means and can't afford the council tax, there's rebates available, it simply means filling in the form online and let the council do the rest. Now I'm over 65 there's usually some form of rebate but as it's my partner's property she has to do the paperwork. As long as the council gets some form of payment or offer of payment, they will stay the court action. If they can't get the full amount from you, they will get the balance from central government. Don't delay, talk to them about your problems. We've found our council tax people are just like us and hate the system as well and are very helpful. |

If they can't get the full amount from you, they will get the balance from central government.
