Edit your post immediately so as not to identify the driver, refer to the driver only as 'the driver'.
It's information you don't give away to parking parasites. Can you get a photo of the signs? Start reading other threads to understand how private parking works, prepare an appeal and post here for critique using that information, you will always be appealing in standing, signage and 'unconscionable under the circumstances'. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Ignoring is not recommended, no.
If it ends in court then a robust 'appeal' putting your case on record is seen as being reasonable. Additionally for BPA companies like Park Watch it means you can get it cancelled at POPLA removing any chance of future actions. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Contact Tesco too - they might not be keen for you to shop elsewhere in the future...

All postal. No attendances like you can have with council appeals.

What do the signs say. Do they say you cannot park outside the bay.
These all turn on the details available to the driver on the day. |

Failing "may" result in a parking charge
First off - you cannot agree to pay for something youre told you cannot do, so no contract No certainty of terms - "may" - so no cotnract. So theyre pretty screwed Its park watch, have you researched them much? |

And you did park within the lines (their version of parking within a bay but thats their problem)
Just not adjacent lines They missed adjacent out so tough for them. Wholly within a bay is not a condition set by the signs. This post has been edited by kommando: Wed, 19 Apr 2017 - 13:00 |

Signage, standing and unconscionable under the circumstances, read other posts, all appeals should contain those three regardless of circumstances and you've been given some hints and tips.
Claiming you were too daft to enter a contract may be an option of course! This post has been edited by The Rookie: Thu, 20 Apr 2017 - 09:07 -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Or if the driver wasn't 18 years old.
The general position when contracting with a minor under the age of 18; a minor. In order to form a legally binding contract the general elements of a contract must be present, for example there must have been an offer, acceptance and an intention to form a legally binding contract. Without all of these elements being in place a contract will not be legally binding. If all these elements are in place a contract with be legally binding, however, the law presumes that certain people do not have the power to enter into a contract. If you have the above elements and enter into a contract with one of the following kinds of people the contract will be void: Children under 7 years of age People who are diagnosed as mentally insane People whose judgement has been impaired by being very drunk or drugged There is no exception in the law along the above lines for a minor meaning that a minor is free to enter into a contract with the contract being legally valid. However, there is an assumption made by the law that a minor cannot fully understand the implications of a contract. The implications of a contact If a minor is assumed not to understand the implications of a contract a minor will remain fully protected by the law even if this is to the disadvantage of the other party and regardless of what clauses have been inserted into the contract. -------------------- The Asda shopping trolley parking ticket enthusiast

Or if the driver wasn't 18 years old. A contract for 'necessaries' will override this. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

right, i have to appeal today (14 days), i know its late but i have had a very tough couple of weeks in my life.
A MOTORCYCLE WAS PARKED TO THE LEFT OF THIS WHEN THE DRIVER ARRIVED SO PARKED LIKE THIS TO SAVE SPACE. the nearest sign is 50-100 metres away and not visible from where the driver parked. the driver parked right near entrance to car park also bizarelly there is another sign which says 'no parking' I have to email 'PARK WATCH' with an appeal tonight. How should i briefly word it before my inevitable POPLA appeal? Any help would be so truly grateful 'The rookie mentioned standing and unconsciable should be included but i'm not sure exacty what that means This post has been edited by robbed again: Sun, 30 Apr 2017 - 18:17 |
