Hi,
I have received a NTK from Horizon Parking saying PCN notice is overdue. The driver never received a ticket on windscreen and neither any PCN came to the registered address. The first communication is NTK. The NTK was issued on 13 Aug and it says the PCN was issued on 10 Jul. The reason for PCN is Parked in Parent and Child Bay. There are no images in the NTK to show the violation. Appreciate if you could advise what needs to be done. Let me know if you need any other info. Thanks Goodboy18 |

I presume there’s no reference to the keeper being liable? (Just the driver)

(Just the driver) Here is the text from the NTK: "We recently issued Parking Charge Notice (PCN) XXXXXX as this vehicle has breached the terms and conditions at XXXXXXX that Horizon Parking (The Creditor) were authorised to manage on 10th July 2019. This PCN was issued on the 10th July 2019 at xx:xx and has not been paid. The reason we issued the PCN to the vehicle is as follows: Parked in Parent and Child Bay. The terms and conditions of parking on this private land are clearly set out on the signage within the car park. By choosing to park within this car park, the driver is bound to these terms and conditions and is liable to pay a charge if the terms and conditions are-breached. We have requested your details from the DVLA as the registered keeper of the vehicle (through the Reasonable Cause criteria of pursuing an outstanding parking charge). If you were not the keeper of the vehicle at the time it was parked or if the vehicle was stolen prior to the beginning of the period of parking which is the subject of this Notice, please let us know. If you were not the driver we ask you to supply the full name and current serviceable postal address of the driver so that liability of the Parking Charge Notice may be transferred to the driver. This PCN was issued on 10th July 2019 and a prompt payment discounted amount of £35.00 was available if paid within 14 days of issue and to date, full payment has not been received. We now request the amount of £70.00 is paid using one of the payment methods described overleaf. If within 28 days we have not received full payment or driver details, an additional charge of £10.00 will be incurred, totalling £80.00 as the Charge, after which the case will then be passed to our Debt Recovery Agent which may escalate to court proceedings to recover the amount owed. Appeal as the keeper:
Dear Over the horizon, I have just received your Parking Charge Notice *** for vehicle *******. You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper. There is no legal requirement to name the driver at the time and I will not be doing so. I do not expect to hear from you again, or from any debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records. Yours The keeper can i mention it I have just received your Notice to Keeper rather than parking charge notice, as there has been no PCN posted to the registered address. ? Hi All,
I've received an almost identical NTK from Horizon Parking to the above. They ask for drivers details. Did/does the suggested text in the reply above deter them from taking furtehr action. Incidently, me and the missus can't recall who was the driver that day - Nor whether we were both in the car. The notice is for exceeding the maximum stay period at our local Tesco by 30 minutes. |

Yes but you should have started your own thread for advice.

Sorry for not posting my exact notice. Just an update - I went with the standard text above (but using their online appeal form), and just had an email from them confirming the cancellation of the PCN. They took just 5 hours to reply!
