Hello
I hope someone can advise. Back on the 12th Aug 2020 I was caught speeding by a manned camera. At the time the cars electrical system lights ,speedo etc stopped working just a couple of hundred yards before said camera. Whilst my attention was focused on the car wondering what was happening. I’d gone through the trap. I waited for a nip to come through but received none, so I thought I’d gotten away with it. Around a month later I moved in with my partner. Changed driving licence came back sept and v5 about month later came back towards end nov. Upto mid nov I was collecting any post from my old address. But then I injured myself at work followed by the COVID lockdown which we are still in. Then on Friday 26th Feb the tenants of my old address text me a photo of the front page of a spjn relating to the original offence and failing to identify the driver. After phoning the helpline she gave me the details of the court and advised me to email and phone them which I did. They have now postponed the hearing from the 9th to the 16th March. The court has sent me a copy of the original spjn to the new address. What I want to know is.. Do I plead guilty to both and put in mitigating circumstances for the address and failing to receive the paperwork. Are they able to drop the failing to provide details. And just proceed with the speeding offence. Or do I plead not guilty to both? Thanks in advance for your help |

What was the speed alleged and the prevailing limit?
Do I plead guilty to both and put in mitigating circumstances for the address and failing to receive the paperwork. Are they able to drop the failing to provide details. And just proceed with the speeding offence. No, that would be good way of getting a minimum of 9 points. Or do I plead not guilty to both? That would be our best advice and also request a personal hearing. Then on the day you need to talk to the prosecutor and get them to agree to drop the "failing" charge in exchange for a guilty plea to the speeding. |

42 in a 30 zone. The road is a connecting road adt 1/2 long or so between to estates. No houses and a wide open road.
It thought that myself pleading guilty would incur loads of points but was unsure if the judge was able drop and just fine for speeding. Looks like not guilty then it is. Have just read another post though, who suggested phoning the police force and explaining not getting the post. In a hope the withdrew the failing to provide name of driver. Thanks for the quick reply. |

Thanks for the quick reply. Too late for that: it's out of the police's hands now. As Baggieboy has said, the only safe way forward is to plead not guilty to both. But you don't need to request a hearing: that will follow automatically. You'll find lots of threads here explaining what you need to do on the day of the hearing. It's pretty straightforward and routine. |
