Hi, the driver received this in the post yesterday and is wondering what to do about it? the driver took their 5 year old to a hospital appointment and parked in the car park next to it. As far as the driver remembered the sign said that you could pay on arrival if you knew how long you were going to be or pay when you left.

The driver paid when they left. It was a very confusing parking meter thing. There were a few other people trying to work out how to use it too. The driver bought a ticket and left. There were no barriers to get in or out.

Ok edit: The van is actually registered in the drivers ex husbands name. How did they get his name and address (well old address, as he hasn't lived there since end of Feb)? Im presuming DVLA? So that would mean they don't have his new address?
The driver paid £1.50 and yes the driver put in the number plate correctly. Couldn't work out if that was the correct amount at the time.

It was a very frustrating situation. There were a few older people trying to work out the machine as well as the driver. The driver was trying to help them. Their 5 year old was running around the car park while cars were passing. The driver was in a massive rush to get the ticket and stop their son getting run over whilst also trying to help the 2 old people!

No the driver hasn't contacted the hospital but will do that. Thank you

The keeper (not the registered keeper) received a Parking Charge Notice on 5th December which looks exactly like the one originally posted apart from it now has the keepers? name on it (spelled incorrectly).

The keeper has rang and left a message with PALS and is waiting for a return call.

Im a bit confused with what needs to be typed, driver/keeper/registered keeper!

Ok PALS have rang the keeper saying that they are getting a lot of these calls at the moment. They took details including ref number on PCN and said a case worker will call in 2-3 days. Was advised to appeal along side this.


So the keeper now needs to say that they had to guess the amount to put in the machine while distracted by the elderly people and a 5 year old running around. Should the keeper basically just put that?

If it was through the post it is clearly a notice to keeper
If the keeper isnt the RK then they must have the keepers address from the appeal - yes or no, no other answer needed

The entire way through the drivers identity must not be revealed. At no point do you ever write anything that tells us who the driver us, because youre telling the entire world.

No, the keeper states the DRIVER had to guess the amount needed to pay, and that as the machine accepted this amount without any indication it was insufficient payment, the MACHINE accepted on the PPCs behalf a variation to any contract

In addition as no notice to keeper was served that meets the requirements of POFA Schedule 4 para 8 (as you state they did not get the RKs address from teh DVLA, because it wasnt sent to the RK) the KEEPER who is the person appealing has no liability.

Tell PALS on Monday that if they dont cancel this they will be up for damages from harassment, and you woudl rather not sue a hospital if you can avoid it.

Nos - Mini history to save you reading back - RK no longer lives with OP but his vehicle is kept by them and V5 has not been updated. OP forwarded the ntk to rk. Suspect the RK has nominated the OP as driver when they have no knowledge of this as they weren't there at the time the vehicle was parked.

Nosferatu - I feel I am being shouted at! Im sorry if Im not posting in the correct way, Im not savvy to all the appropriate language! I just feel that this pcn is very unjust as the driver paid for parking on the day and was under the impression that the correct amount was paid as the machine released a ticket.

The pcn was received in the post on 5th Dec.


The PALS person at the hospital said they have had numerous complaints in regards to PCNs from Parking Eye for the same reason.

Record that call when PALS phone back. Try and get them to confirm that they will be instructing PE to cancel and then get it in writing.

The person on the day was the driver
The keeper is the person who keeps the vehicle day to day, and may be a driver of the vehicle, but does not have to be THE dtriver on the day
The registered keeper is who the DVLA records as being the Keeper.

Edit required.

You really need to get your head round this one or you could be digging a hole.

Your ex is the registered keeper. (the person that DVLA has the details for, even though they are wrong, i.e. not his new address)

You are the keeper. (the car stays with you and you have it day to day)

The driver is an unknown person that allegedly parked without paying sufficient. (Parking Eye don't know who was driving so keep it that way, we don't need to know either. Imagine you'd won the lottery and it was your chauffeur cool.gif )


Can you redact the personal info off of the new notice that you have received and post it up so that the experts can help?

PALS have rang and left a message regarding this. The lady said she has escalated it to a manager and I will get a response by 7th January.

The driver received a letter from Parking Eye a few days ago...It said

'We refer to the parking charge incurred on 15 October 2018 at 10.56, at South Bristol Community Hospital car park.

We can confirm that this Parking Charge has now been cancelled and there is no outstanding payment due.'
