My friend received the attached PCN. They have moved address recently and only received the PCN due to the royal mail redirect service. They tried to pay at two machines but could get the card payment to work.

The title of your thread seems to be jumping ahead somewhat - before court there should be an appeal to Smart, then an appeal to POPLA (where Smart are often one of the easiest companies to beat). Edit your post so that you do not reveal who was driving. "The driver" drove, and your friend should deal with the matter as the keeper.
Use Imgur or an alternative third party image host to upload the photos. It would be easier if your friend could join this forum and post themselves, to avoid the risk of Chinese whispers. -------------------- Useful Links (for private parking charges):

my thinking when asking about court was that if the issuers haven't taken anyone to court I might ignore the PCN

A lot of private parking DO sue victims , and have 6 years to do so , so never say Never!
I am sure that I have seen court claims by Smart Parking That is only half of the pcn , no view of the back ! Also we cannot see any dates, so difficult to comment regarding keeper liability No pictures of the signage onsite either This post has been edited by Redx: Sat, 25 Jun 2022 - 08:05 |

They have missed chunks of POFA and not able to hold the keeper liable. but give us the requested including the dates.

if the issuers haven't taken anyone to court I might ignore the PCN Smart are often one of the easier companies to beat at POPLA, a win there sees a definite end to the matter, rather than 6 years of uncertainty waiting to see if they try court. Even if they were a company who usually don't do court, I'd advise against ignoring - during COVID we've seen some normally court-shy companies taking more cases to court, and if they do, then a defendant who has ignored them can look unreasonable in the eyes of the court. -------------------- Useful Links (for private parking charges):

Smart have issues with their contract with the landowner, and so when this is challenged at popla they seem to fold rather than supply the contract.
