Hello,
I received a PCN on Saturday 15-September-2018 about a left turn that I made in Kingston. Thing is, I did make the turn. I genuinely did not see the no left turn as it was on the opposite side of the pavement. The sign is clearly visible if you happen to look at the signs on the other side of the road (perhaps I should have). When my vehicle was turning (too late to go back), I saw the no entry sign. This happened on 16-August-2018. I did not receive the PCN until the 15th, the date of notice is the 12-September-2018. For one week I thought I was bang to rights and was about to pay. But, I am wondering if there is any technicality that may get me off. I came across this case: http://forums.pepipoo.com/index.php?showtopic=65828 The ticket was invalid due to the fact that they did not provide the full 14 days. Being a bit thick, I can't work out why. Can anyone take a look at my PCN (attached) and tell me if there is anything I can do? Or if I should just go ahead and pay. Thank you very much. PS. Apologies for the quality, page 1 was eaten by the printer and I ripped the top right hand corner of the page trying to pull it out of the printer! They MUST send the PCN on the date of the PCN, and by 1st Class post. You need to check this, but if it is a mail delay, tough sh*t, I'm afraid,

Thanks for your reply. Yes they sent it first class with the 'Advanced Mail' service. I will call the council now and ask them exactly when they sent it and post an update.

I spoke to Kingston, they told me that on their system, the letter was sent on the same day.
Therefore, is anyone able to look at the ticket and tell me if there is anything that can be done or should I just pay? Thank you. |

I don't know whether I am clutching at straws here, but has anyone ever won on the grounds that the no turning left sign was on the other side of the carriageway. I'm used to seeing the signs on the left hand side. So, when I failed to see the no left turn sign, I turned left. When it was too late, I saw the no entry signs.
Again, I don't know whether i am clutching at straws here... |

No entry signs create a strict liability offence, so when you saw them you should have jumped on the brakes. But that's in the past now.
The PCN has a flaw, it mis-states the period during which the council may increase the penalty charge, as the 28 day period for Charge Certificate purposes starts with the date of service of the PCN, rather than the date of the PCN. We've seen mixed outcomes at the tribunal but it's the only basis of appeal that I can see. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php
