hi,

A relative of mine has received 2 penalty charge notices of £130 each.

Looking at the details what we know has happened is their ANPR failed as it got the last digit wrong. The number plate may have a slight crack in it or something but the cameras have the last digit as M when it should be H.

The car is the same make but different model of my relatives car.

This has had them feeling very distressed as they are old and they thought they were a victim of license plate cloning.


Is there any chance of compensation from Transport for London?

Did they appeal the fines?

Did they pay the fines?

Have they contacted TfL to point out the mistake?

How did they get the PCNs then? Must have the correct VRM and address from DVLA to send them.

So 2 PCNs that are referring to relatives registration number, presumably ending in M.
Photos on the PCNs show that the last digit is H.
And the H is readable in the photos on the PCN(s)
Is this correct ?

If so, simples and no need to worry but they do need to challenge the PCNs as per the system.

I am not the owner or registered keeper of the vehicle involved.
The photos clearly show that the registration number of the offending vehicle is not the same as the my vehicle registration.

I assume the error is due to a mis-read of the vehicle plates and therefore the PCNs were issued to me in error.
I enclose your photo showing the correct number plate.
Please note the last digit is H.
Please confirm cancelation of the PCN.

Same for both PCNs
If the vehicle is visually different to yours, you can enclose some photos you your car highlighting the differences.
But be very clear with any challenge, this is not my car, PCN issued to the wrong vehicle.

On compensation, see what happens first. If TFL do what they should and simply cancel, fine, the system worked in correcting an error.
Should it go further, official complaints, costs whatever can be pursued but most can be hoped for at moment is an apology.

Thanks for the quick responses.

They haven't appealed the fine or paid for it.

They have only contacted them on social media pointing out the mistake.

I am currently writing out a formal response to send to them using their own format although there isn't an option to select for their fault.

From the photos the last digit looks questionable. But the model of car is different this was confirmed by typing in what we assumed was the correct reg and it shows the same car as the one in the picture.

Deffo include pictures of their car then, alongside the PCN pics and highlight differences, should be fairly simple if a different model.
This is our car, it is a Ford Fiesta (or whatever).
This is the offending car, it is a Ford Ranger.
Simple but clear.

The option to tick is that there was no contravention (as a different vehicle to yours is shown in the evidence)

OP, you are rather dancing around this.

Forget getting in a complaint about 'their' fault, at present it's clouding your thinking.

So, your priorities are to get the owner to submit reps in time. Not you, you have no standing.

But what is 'In time'?

We don't know, but it is the single most important issue at present.

So, dates PCNs issued please and let's take things one step at a time.
Also, take a photo of the V5C page with the vehicle description, including colour, and of the car itself with numberplate in clear view.

OP, as others have said the priority is to get these PCNs cancelled, and there is a Legal process to follow, which does not include Social Media - stepping outside it is a recipe for disaster.
Get your relative to write the letter (or you write it and get them to sign it) as suggested by DancingDad and the evidence suggested by HCA above using the "Contravention did not occur" reason.
Make sure you keep a copy, and if using Royal Mail, go to a Post Office Counter and get a Certificate of Posting (free) to prove it was sent.
It is highly unlikely that any claim for compensation will succeed, but the time to put in a complaint is not now.
