Accident in Hire Van

Hello all,

Looking for some advice on some additional fees I have just been charged after an accident in a hired van:

Not disputing liability as it was my fault. I had the excess insurance and on returning the van was told I wouldn't need to pay anything else as I was covered. Just had an e-mail from the Hire Company telling me they they have charged me another £250 for the vehicle being unable to be used whilst it's repaired. This type of additional charge is in their T&C's buried on the website, but they did not make me aware of it when I signed the paperwork, nor is it on any of the paperwork I have signed.

Any thoughts on if they are just 'trying it on' or if it is a legitimate charge? If it is a legitimate charge I will happily pay it.

I suppose it all depends on what the terms state, and what terms the excess waiver had too. All should have been clearly on the form you signed, not hidden away on the website.

Do you have a copy of the documents to post on here? (Redacted of course)

Sounds like they are trying it on. Forget the T&C's on the website, what did it say on the rental contract?

The sensible thing being that an insurance policy normally covers the claim minus the excess is that all aspects of the claim are settled and you pay only one excess once.

The claim would, as in the case of most other common insurance policies cover the repair, replacement vehicle for the duration and incidental losses.

I would not expect to have an excess applied twice, nor would any policy I've yet entered in to compel me to do so.

However the above is all academic if your rental agreement says otherwise.

Read that and establish your position, and if there's no mention of paying twice then tell them to clear off.

Thank everyone so far... They have changed tack and insist it was on the rental agreement I signed, which seems odd as my copy doesn't have it on, nor does the copy they sent me as proof! I have told them if they charge my card without my permission I will instruct my CC company to claim it back. They have now gone quiet.

Smart move, you have exposed them. If only everyone fought back like this. If there is nothing of the sort on the agreement and they charge the CC, call the credit card company immediately and ask for a charge back.

Good move. I once did a charge back and it took 2 months for the investigation to be complete, but in the meantime the charge was frozen meaning I did not have to pay it until it was resolved, and ultimately they cancelled the charge.
