Hello everyone
Unfortunately, my husband has gone and got himself another PCN. This time it's one that was stuck on his car. I haven't seen any photos of the situation yet - I think they will be uploaded tomorrow at the earliest as he only received the PCN today. I have uploaded a copy of the PCN. It would be much appreciated if anyone is able to identify any possible grounds for appeal based on the PCN itself for now. Thanks so much in advance :-)

PCNs for "Footway Parking" can be difficult to defend, as it's been banned throughout London since 1974, and needs no signs.
Please post the pics and GSV and we can have a look. |

Thanks for your replies. I attach 2 out of 9 CEO photos. The others seem to be too large so I'll have to try to reduce the size somehow. Funnily enough, some of the photos are clearly accidental ones that shouldn't have been uploaded! I will add the GSV link shortly if I can find it (husband is working). Did anyone see any wording on the PCN that might not be legally compliant? Thanks :-) |

Where would I find the guidelines? (3)Civil enforcement officers— (a)when exercising specified functions must wear such uniform as may be determined by the enforcement authority in accordance with guidelines issued by the appropriate national authority, and (b)must not exercise any of those functions when not in uniform. I can see that the TMA 2004 is relevant as this is the legislation referred to on the PCN, but please could anyone let me know whether there are other pieces of legislation? Hubby has received a PCN stuck on the windscreen in the past and I'm sure there are some regulations that are fairly prescriptive but I can't remember what they are called :-( |

The only other regs I know of are The Civil Enforcement Officers (Wearing of Uniforms) (England) Regulations 2007 but they don't add much. The key issue is, for the CEO to have his powers he must be plainly identifiable and his uniform must indicate he is undertaking parking enforcement. Whether his high-viz vest complied with that is anyone's guess. The green "NATO" jumper that can be seen in one of the photo's is what Richmond give their CEOs. OP, as cp8759 says, your hubby I bang to rights on this one - my advice would be to pay at the discount. |
