Hi all
I received a council PCN today for parking in a special enforcement area adjacent to a dropped footway. To be honest, I had parked covering a dropped footway but I did not notice it or realise in the morning! They haven't given me any links for photograph or anything. I do not know what other details you need - Road I parked on - Byfleet Road, New Haw [https://goo.gl/maps/PgxLFwEgZ94ZkX1S9] Time of contravention - 24/01/2020 13:26 Location - Byfleet Road Observed from - 13:24 to 13:26 Notice by Runneymede Borough Council [acting as agent for Surrey Country Council] I was just wondering if people with more knowledge than me would know of any grounds for me appealing the PCN? pay the discount - you are slap bang across a crossing marked by tactile paving. Although way back in 2014 the opposite side was rather overgrown.

I too think you should pay but, if those are the Council's photos, why are there 2 time stamps?
Maybe you should post up the PCN (both sides) minus number and VRM so we can check it's OK. Mick |

TBH at £35 I would pay this and get on with my life.
If, however, you want to take it further I would phone the Parking Manager on 01932 425194 or e-mail mervyn.robins@runnymede.gov.uk and ask why the evidence photos have two time stamps. Since the PCN directs you to the Council's website I would also ask him why it indicates that non-payment of the PCN will cause the Council to register this penalty as a debt, which will incur an additional charge. They will then take action to recover the outstanding charges using enforcement agents who are also able to add their recovery fees. (The legislation indicates they may do the above not will do so). https://www.runnymede.gov.uk/article/14470/...ing-enforcement The wording of the PCN is not too clever but I think they just scape over the line vis-a-vis the Appeal Regs. Mick Tbh cant be asked to go further - paid £35 - end of! May I ask - is it an offence to park around a corner? So in that same location, just in front of the dropped kerb? |

If there are no yellow lines and no dropped kerb you can (there is another dropped kerb there), but you need to be careful at junctions as police can consider a vehicle is causing obstruction. Rule 243 of the Highway Code says: DO NOT stop or park: opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space but in quiet back streets this is usually not an issue and major road are often already covered by restrictions such s yellow lines. |

I'd read the lot. And of course 'obstruction' which is enforced by the police comes in many forms. Speculating... The reason that gaps in parked traffic exist is often that this is where parking may not take place. But gaps are awfully enticing, almost as if one's fairy Godmother is clearing a path just for you.
