2 days ago I received a call from a warrant office at my house. She claimed I had a bail warrant on me and that was because i failed to turn up to court. This is the first I had heard about the situation. To cut a long story short.
Someone was stopped in October by police, they gave my name and date of birth but not my address. I am not the registered keeper of this car. The Police gave this person a producer. The person failed to produce. From this point on the police seem to have not followed a logical way of investigating this breach of failure to provide information. At the court the prosecutor acknowledged that that the logical process has not been followed which i assume would be to contact the registered keeper of the vehicle, the name of the registered keeper was mentioned I do not know this person. Instead they sent any requests and subsequent summons to the address the person provided who alleged to be me when stopped by the police. As i don't live at this address I have been charged with failure to provide information and apparently also been given 6 points. Now I went in to the magistrates to sort this out, when I spoke to the speaker he said OK so you have come for your sentence and it seemed as far as they were concerned the matter was coming to a close. I explained the situation I was in and this is the first I am hearing about everything, after having a discussion with the presiding judge, prosecutor and speaker, they have decided to reopen the case to investigate further, I will either get a letter stating they are dropping all charges or that this will go to trial, I can only assume either the police officer would have to identify or they would have to get a statement from the registered keeper for it to go to trial. I am quite confident that this matter will be resolved correctly, but I am also aware that the police have targets and a thing called clearance rate where the police focus on appearing to solve crimes (generating high clearance rate scores) rather than actually solving crimes. Which is why i believe I find myself in this situation. This is the most worrying aspect of dealing with the situation, Common sense has not prevailed so far. This has obviously caused me a lot of distress. I have felt dizzy when I lie down and stand up for the last few days. I will want to put a complaint in after things have cleared up. Can anyone offer me any advice on what would be the best way to deal with the Police in this matter. I want to ensure that the superiors of the person who has instigated this against me know that they are doing a bad job. Would I need to go to the IPCC? Also If I am entitled to any compensation due to distress caused i would seek it, but I'm not sure that I can. Any advice and words of wisdom would be welcome, sorry if I have gone on a bit. I have not had a chance to speak to a solicitor but will have to get one if this goes to trial. Fingers crossed this will not happen, but then I move back to my argument about Police clearance rates. I can tell you all now that the the case against me has been discontinued on the grounds that there are issues with identification. I found this out on Tuesday the 27th when I went to court. They posted a letter to my solicitor the day before to advise. Nice one D&^( heads.
By the way, I did not pay my solicitor anything as I had arranged him through my uncle who is a barrister. Whilst i was at court he made sure he sorted his costs out. I dont know how much he would charge but for this sort of stuff i am told it is a good few grand. Whilst I was sat there I saw a sign which said Rochdale magistrates will be closing and all operations will move to Bury, Im not surprised. Just so you know what this was about, My name was given by a registered keeper of a car on the scene of an accident, he said he lent his car and was there to collect his car. He gave an address but that was not my address. This guy did not know me he just made a name up. The police summonsed me to court over this on failure to provide info. Picked my name out of their database and assumed it must be me. Even though i have no connection with the address. They discontinued at last minute, They probably would have walked all over me if i did not have a solicitor who could speak to them at the same level. if I did it myself it probably would have been like smashing my head against a brick wall and stressful |

I never did respond to this with outcome. Case was dropped not enough evidence. I turned up for the trial with solicitor only to be told they sent a letter out the day before case was dismissed. I received the letter day after trial date.
