Hi
Hope someone can help me dispute this PCN I have received by post- while checking into my hotel i parked in a marked bay and went and checked in and was given my key to the hotel car park. however an attendant then saw my car and started to issue ticket. I drove away before he could print and affix the ticket - but i have since received the attached in the post. What are the regulations around this can I dispute this via a formal representation ? All comments welcome - Many thanks Leaf

That was unlucky although in London you must expect a PCN whenever you leave a car unattended and you must find a pay bay even for 10 mins or so.
This is where you were: https://www.google.co.uk/maps/@51.5160822,-...#33;6m1!1e1 Coincidentally you were there on a Friday but outside the Friday parking time which I expect is there for the mosque. You can ask for the CEO observation time - Tower Hamlets policy is 5 mins before issuing a ticket - I expect it was shorter. How long were you in the hotel? One of the exemptions to this contravention is O. A vehicle waiting while a gate or barrier is opened/closed to allow access or departure to/from premises making contact and collecting keys is allowed.
Also the loading if you had luggage -------------------- All advice is given freely. It is given without guarantee and responsibility for its use rests with the user

It did take a while to get checked in and my 10-15 mins so not sure how long the officer had seen the car - he did only seem to have arrived as he was still trying to fill in and print the ticket. he shouted that he would post it. they used to have to put the period of contravention on the PCN - not sure why they don't any more.

Thanks PASTMYBEST - i will dispute based on your thoughts there. If you had the PCN they would have put on the car it will have had the observation time. PMB's mention of collecting keys etc could work - I wasn't aware of that - but it may hinge on how long the CEO was observing. They are not to know you hadn't just gone and in out for 2-3 mins if they only just spotted the car. |

Unless the authority would re-offer the discount in the event of unsuccessful representations, then why risk the discount on what is a tissue-thin argument (no disrespect, but your reps appear to be reps for the sake of reps). IMO, whatever sympathy you might get from an adjudicator would be lost because you drove away instead of just accepting the PCN. This is frowned upon, do not be in any doubt.
But remember, YOU cannot make reps in your personal capacity, the PCN is addressed to a company and therefore the company must respond. You could do this in practice, but not in your name and you should state in the reps what authority you have to respond. |
