CCJ Issued by Parking Eye

Hi All,

My wife has had some sporadic correspondence from Parking Eye with regards to a PCN issued at a car park in Cornwall and today she has discovered a CCJ against her name.

When we initially received the PCN we were slightly bemused as we had paid to park and added extra as we had gone over on the time.

After a little research we were advised that no further action was necessary due to us having paid to park and months went by with no further correspondence from PE was received.

In early November my wife received a claim form the County Court Business Centre in Northampton, some internet research suggested that this was not a legally supported letter and that the business centre was not a "proper" court. Due to this we decided not to respond to the letter.

Fast forward to today and my wife was most shocked when she did a credit check and found that there was a CCJ against her placed by the aforementioned County Court Business Centre in Northampton

The advice that I am looking for is:

1 - What would you suggest as the best course of action in order to try and get the CCJ set aside?

2 - Can parking eye prove that the correct documentation has been issued as we only have received sporadic correspondence?

Difficult for a set aside as you received the claim form and ignored.

Where on earth did you find the information to ignore the PCN and the claim form? It has not been the advice to ignore since schedule 4 of The Protection of Freedoms Act 2012

You could ask PE if they would agree to a setaside on the condition that you paid judgement and the fee

Indeed, ignoring the court claim form was stupid. Sorry, but it was. You could have gone to the GIVERNMENT WEBSITE on the form, entered the claim ref and seen it was genuine

Best you can do - and you must do this MONDAY - is call parking eye
Ask if they will agree to a set aside by consent , and you will pay all fees, draft the consent order (search) and pay the ccj in full.

Do not delay
If you do not of this this week, including getting the draft consent order signed by them, and the n244 filed with the court - the court could decide you did not act promptly and refuse your application.

No joke
This is your ONLY option
Your 2 is irrelevant. Completely and utterly irrelevant. You are so far past this stage it's laughable. The ONLY thing that can be done now is try to repair the credit file. Nothing more.

To get a CCJ set aside is usually a costly pain. It costs £255 for that. If writing to the court to get it set aside you need a very good reason as to why..ie.. Moved house.

You're wasting your time contacting parking eye to get them to set it aside, they wont do it. I have personally been there and done that, as well as researching for many hours. You can try but the chances are you will not succeed via parking eye.

It was the biggest mistake to ignore the court papers. If you responded and paid it you would not have a CCJ.

It's £100 if PE agree to the set aside and you agree to pay PE the judgement as well. Ask and see if they are willing to.

Poor research and the wrong conclusion I'm afraid. The claim form (letter) was a fully legal system recognised claim and while the business centre isn't a court where hearings occur they probably issue more judgements (as default judgements like yours) than any court.

Just off the wall suggestion here. Does you wife already have a poor credit record? Was there a reason to do the credit check?

No it doesnt cost £255 if going for a set aside by consent, I've already pointed that out above. Its £100 as it does nto require a hearing

Theyve signed sonsent orders dozens of times. Youre either lying about having tried it yourself, or you are very, very bad at communicating with people.

The only thing youve said so far that is remotely true

Please stop spreading lies, having just come back from 7 days suspension for saying you would tell everyone to always pay PCNs.
Ive seen youre already doing this on other threads.
