NIP Details and Circumstances
What is the name of the Constabulary? -
Date of the offence: - January 2019
Date of the NIP: - 8 days after the offence
Date you received the NIP: - 9 days after the offence
Location of offence (exact location as it appears on the NIP: important): - Langdale Road Dunstable outside school, Bedfordshire, United Kingdom
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I have never visited the location given on the NIP as the location for the speed camera

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Where was your car at the time of the alleged offence?

I was driving the car in the NIP about 5 miles away from the the address in the NIP

So, I was driving on a different road (in the same county) with my wife as a witness.

Apologies, it was more like 10 miles away

My preferred approach is to make an initial bemused phone call (once 14 days has passed from the offence).

Either it's a plate misread or a mistake on the location itself. Given the proximity then I suspect the latter.

I suspect the latter too, there was another speed camera very much closer to where I was at the time on the NIP

If so and they realise their mistake they may well drop it.

Hopefully, the standing advice on this website seems to be to wait until 14 days after the NIP (so they can't just give you a new NIP at a different location) and then call them...

That's what I would do

Make a note of who you speak to

I would still return the S172, stapled to a letter that denies the car was present and refers to the conversation
Keep a copy and ask the Post Office for a certificate of sending

What's odd about this case is the precise description as outside a school

Usually these errors concern a name change along a road, a road with a similar name or an officer parked on one road to monitor another nearby
Wonder if somebody forgot to change the location on the template

Okay, there is a speed camera outside a school on the location they have put on the NIP. Interestingly, there is also a speed camera outside a school at the location I was most likely at around the time they claim, but it is 10 miles away from the one on the NIP

Langdale Road has a 20mph zone at the camera location. What speed, if any, has been given? Of course, the other location may also have a 20mph limit if it's close to a school.

Hi, my NIP stated that I was doing 39 mph in a 30 mph zone. Thanks to everyone for their help, I got a cancellation notice yesterday when I got home. Strangely, they wrote that they were taking into account the representations I had made to them, when I hadn’t had a chance to write to them yet. All’s well that ends well!

Sounds like another driver has already contacted them and they've realised that all the NIPs were wrong for that session
