There is no need for one, you just submit the form completed as required.
They may well send an offer of a fixed penalty which you would be free to ignore. This post has been edited by The Rookie: Sun, 20 Jan 2019 - 19:13 -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

I think the potential issue with the Avon and Somerset combined nip is that there is one page which allows you to either:- - nominate another driver - nominate yourself and reject the fixed penalty or course (it gives a variety of reasons for rejecting the offer of a course) The other pages allow one to nominate oneself and accept FP or Course. The rejection of the fp and self nomination would presumably lead to an SJPN (I dont think that particularly invalidates what you say, however the form - from my memory of the last one I had) does not give an ability to nominate oneself and nothing else. |

Why would it lead to an SJPN, it’s out of time, even A&S aren’t that disorganised as to know when the game is up.

I was merely pointing out that it may not get adequate oversight. You may well be right and it just be quietly dropped.
Perhaps "presumably" was too strong a choice of word. |

Doesn't this meet the requirement ? Staple a covering note that the form has been completed to comply with S172 obligations although no prosecution for the underlying offence is now possible |

Thank you everyone I will reply tonight with the following
ref: - ********************* SEU PO BOX 213, Bristol, BS20 1DR Dear Sir/Madam I am writing this cover letter in response to the request for details for notice of intended prosecution ref:- ********************* (Included ) I wish to confirm I was driving the vehicle at time of the alleged offence but noticed the time span between the date of offence is now over 6 months. With advice from ask the police web site I received the following information: - Thank you for your email. Summary offences (those dealt with by Magistrates Court) e.g. speeding, have a statutory time limit of 6 months from the date of the offence, in order to lay (give) the information and commence proceedings. We hope this information is of use. Regards, PNLD(CS) The form has been completed to comply with S172 obligations although it appears no prosecution for the underlying offence is now possible Could you please let me know the next stage? |

Why bother with the form at all? Just provide the required information in your letter.

Don't mention the Ask the Police website. If you really want to reference something, it's section 127 of the Magistrates’ Courts Act 1980 but to be honest it's unnecessary, the people you are writing to know about the six month rule.
Why bother with the form at all? Just provide the required information in your letter. But if you do that, make sure to include all the information that is required (including date of birth and driving licence number). One advantage of using the form is that you'll notice if you accidentally leave one of the nomination fields blank. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

Please note that the offence will remain on record as an offence did occur. Ignominious defeat... -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Please note that the offence will remain on record as an offence did occur. You could write back asking them to confirm that only an alleged offence will remain on record, as everyone is presumed innocent until proven guilty in a court of law -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php
