Hi All - live outside a business park. My mother is a disabled lady who requires easy access to a house and uses my car. I spoke to the council who allowed me to park directly outside my house on double yellow lines as long as my disabled badge is shown. However the road which i park is close to a business park - the landowner only owns the confines of inside the business park unless he can own public roads with yellow lines ?
Said owner has asked me to not park outside the gates or i must pay £50 for a monthly parking permit to ParkDirectUK. Which i refused, regardless i have been parking there now for 9 months with no issues - a parking sign has now popped up outside the gate which i have attached and this monday i found a ticket on my windshield. the parking issue reason was 'parking in a no parking area'. I appealed with photos on the basis i was parked outside the business park however they have now rejected it and just attached photos of my car parked outside with the new sign attached which makes it seem like i was parked within their land. I have clear photos evidence my car was parked outside with the ticket still on the dashboard. with the double yellows on the ground. - I totally understand if the council gave me a ticket but a greedy landowner i cannot accept. - it says i have 7 days to reply or it will go to an 'arbitration process' Can someone please help - how can i get proof this is not within their grounds and boundaries.? Is this winnable? I have attached photos which should help |

Cease and desist letter and then an injunction if necessary.
It may be possible to apply for a discretionary disabled parking space from the local authority (given DYL the chances are low but it might be worth trying). |

I would wait for the outcome of the IAS appeal for the first pcn, wait for the 2nd pcn to arrive in the post and appeal it on the same grounds as pcn 1, especially if the IAS rule in your favour for appeal 1
After say 3 or more then a pattern either has emerged or is emerging, with a paper trail of proof, such that a complaint could be made to the dvla, to the IAS, to your local councillor and to your local MP as well, never mind the council or trading standards or reporting it to the police as possible fraud by deception A cease and desist letter would be good after 3 to 6 successful wins So several pcns proving a pattern is a trail of proof, hard to deny, then see what comes out of it This post has been edited by Redx: Wed, 29 Mar 2023 - 10:07 |

You've contacted the council - who have replied quickly - and as I thought they routed it through parking! Now you have their response you write to Trading Standards and say......but they are issuing tickets - give them examples incl NTDs and photos plus correspondence- so what do you intend to do about it? Sorry, but IMO injunctions etc. etc. can be put to one side, as much as anything else because such approaches places too much onus on you. Get the council to bring their weight to bear on this. It would take nothing more than a letter from them to bring this sorry saga to an end. NB. not all council officers are of the parking authority ilk, others such as Trading Standards are normally keen, committed, qualified and good. I wouldn't be surprised if the council didn't manage to obtain recovery on behalf of others who have been scammed. It goes without saying that once this is completed you would write to IPC. ..and given that there are local elections in Slough this May, anything less than a real clampdown might go down well in the papers and opposition hopefuls. |

It is a pain in the butt when people act like this. "You can't do that" "We just did, your move" Hopefully the company will see sensewithout inconveniencing OP too much more. |

Great responses overall.
I gave the said company a call. Armed with all this information, and I told them about my second ticket and the number. I then said I now have written communication regarding ownership if ParkingDirect choose to ticket me again they will be showing a pattern of fraud and deception based on the fact stated in my appeal - and I will be pursuing various routes of action. 3 minutes after I got off the phone I got an email saying they have cancelled the second ticket and parking attendants have been notified. Only one ticket left which is with the IAS … if I came here first before my knee jerk appeal I would have won both. Thanks all hopefully the end of a short lived saga. I would be tempted to reply to IAS saying thanks for the heads up but ... the ticket wasn't paid as it was clear they were ticketing on council owned property and acting in a manner that could constitute fraud.

Good result, well done for your perseverance.
As mick says, if you're suitably inclined you could point out to the IAS and/or IPC to inform them the operator is being somewhat economical with the truth. Whether they'll care is another matter. -------------------- Useful Links (for private parking charges):

Said parking company came at the dead of night last night and removed the sign on the gate just were the double yellow lines end. Dodgy operation to say the least - im sure the landowner is in collusion with them. |

Farnham Road slip The parking signs on the estate entrance were not in place in October 2022 GSV. Farnham Road is regularly subject to parking enforcement and it may be that the council will now take more interest in enforcing the slip road DYL if the estate management. complain. It's a tight turn from the main road for an artic especially if obstructed by a parked vehicle. |

im sure the landowner is in collusion with them.
