My daughter, who does her best to be law-abiding, came back from work 2 days ago to find her car clamped. It had been clamped on behalf of DVLA because it as untaxed. I'll tell the full story later if it is warranted, but it turns out that the tax expired in January. She received no notification or reminders. She moved flat in something of a hurry because of her flatmate's behaviour, couldn't find the V5 so submitted a V62. Her V5 arrived, again without comment dated 22 January 2019. DVLA have told her that reminders about tax expiring are not necessarily sent - it's only done as a 'courtesy'. My first question thus is - can anyone corroborate that they have NOT received a reminder from DVLA 8 weeks before the due date or any subsequent reminders to tax a vehicle?

Yes thanks, Peter, but that is not the question I posed.

Yes thanks, Peter, but that is not the question I posed. I haven't received a reminder for any of my cars for years. -------------------- |

I used to receive reminders until I started taxing my cars via direct debit. The only time I didn't, there was a marker on my car which had to be removed after a VOSA check.

I've never had a reminder 8 weeks before the tax is due. My reminders always arrive about 3 weeks before the date.

Reminders aren’t relevant, what matters is whether it was taxed or not, the answer appears not.

Unfortunately doing away with the paper tax discs makes this sort of thing much more likely, and although it saves DVLA some money the lost revenue is many times that. I am afraid the absence of a reminder is not going to be accepted as any mitigation, and there is nothing much for it but to accept the charges and back tax.

Reminders, if sent, should arrive during final taxed month, at last known RK preferred contact address.
Nothing ro stop the RK putting the month of next Road Tax Licence Renewal month in the now defunct w/s License Holder. |

I am afraid the absence of a reminder is not going to be accepted as any mitigation, and there is nothing much for it but to accept the charges and back tax. They have done their best to get it all back from her; tax for next year plus arrears plus 2 'reports of an untaxed vehicle brought to our attention' at £83 plus unclamping fee - total cost £449. Let me emphasise - while she accepts ignorance of the Law is no defence, the first intimation she had of the whole unpleasantness is finding the wheel clamp; one letter informing her of the fine was received the day later and the other still hasn't arrived, although DVLA have it on their records and could tell her about it when she phoned. She's considering whether the better approach is a letter of appeal to DVLA or letter of complaint copied to her MP... |

She's considering whether the better approach is a letter of appeal to DVLA or letter of complaint copied to her MP... She could try the first, though I believe she will get short shrift. Her MP is most unlikely to become involved. It seems there has been no breach of procedure so I can't see why (s)he should. Worth a stamp to the DVLA, though, explaining the circumstances. The problem is that, as with all these things (such as insurance), it is the individual's responsibility to keep track of when things expire and to undertake the renewals. Unfortunately with vehicles you have a big chunk of metal sitting in the street which can be used as "leverage" to secure payment. |

Use something like this in future like I do for my two sports cars that are not always taxed..
Tax_Disc_reminder.pdf ( 180.15K ) Number of downloads: 136 You can create this in MS Word, and change colours each time you tax the car. I tried to send my own Word file but it won't let me. |

I get reminders but usually about 3 weeks before due, definitely not 8.
