2x NIPs from the same camera, same time, different speeds

Hello, today I received 2 seperate NIPs

1 - for 48 in a 40
2 - for 49 in a 40

The alleged NIPs are both at the same time, date and location

Has anybody had a similar experience or can anybody offer any advice... could there be a case for the camera being unreliable/wrongly calibrated?

It was an automatic camera on the managed motorway section of the M62

How accurate is the time? Seconds as well?

What is the location? (Exactly the same for both?)

I'd ensure 14 days has passed since the allegation and make a bemused phone call.

The seconds are not shown on the notices, but they are the same to the minute; and the location is exactly the same for both.

I’ve logged on to view the pictures which are not particularly clear but it looks like one is my car and the other is somebody else

What is the significance of calling after 14 days of the allegation?

The first NIP to the Registered Keeper at his last known address must be served within 14 days. After that a new "First" NIP cannot be issued (well, it can, but it would not meet the legal requirements for a prosecution to proceed). If there is a need to issue a new NIP correcting errors on the first it will not be valid. Any request to provide the driver's details remains valid and must be responded to, however.

That's interesting. It appears they've sent you someone else's (alleged) offence...

That bemused phone call is needed - but alas I suspect one of the offences is yours. I see no reason to doubt the accuracy of the measurement but the back office seems to have misprocessed one of the photos.

And if you feel generous, wait 14 days before calling.

That should give the other driver a get out of jail free card.
