NIP Details and Circumstances
What is the name of the Constabulary? -
Date of the offence: - May 2018
Date of the NIP: - 36 days after the offence
Date you received the NIP: - 37 days after the offence
Location of offence (exact location as it appears on the NIP: important): - East Bergholt to Stratford St Mary, Suffolk, UNITED KINGDOM
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? - Named driver on insurance
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - My partner, and registered keeper of the vehicle, was on the stretch of road the alleged offence took place possibly around the time of the offence. Although, the NIP states it was recorded by an "automatic camera device" and we are not sure of the actual time she drove through that part of the A12.
This is the first correspondence we've had, she has not named me as driver for this alleged offence.
Although this is addressed to me, the way it's written is the same as my Facebook account name, not the way I'd normally write my name.

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - No
Is the NIP addressed to you personally? - Yes
Although you are not the Registered Keeper, were you the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No
As you were not responsible for the vehicle, somebody else has named you as the driver. Were you driving? - No
Do you know who was driving? - Yes

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • Complete the Section 172 statement naming the person you believe was driving.
You aren't incriminating them - they'll receive a NIP to complete themselves in due course.

(You might also like to let that person know that they can expect to receive one, and give them the link to this Wizard for when it arrives!)

This is the first correspondence we've had, she has not named me as driver for this alleged offence.

Check the v5 for when the keeper details were updated, perhaps the first NIP went elsewhere or there's an issue that's made them use the insurance database.

What's the alleged speed? It's a SPECS average speed area (70mph for cars). No reason to doubt the measurement.

I travel though there quite regularly.

That could be it.. we bought the car on the 24th April but (I think) the V5 was produced on the 14th May (found this date as part of the document ref no)..
Didn't even occur to me, feels like we've had the car for longer..

Yes, it seems the DVLA record wasn't updated when they were accessed - so went to previous keeper. Depending on the response the insurance database may have been accessed.

Indeed, frontal pictures may have been used to contact the correct gender.

Alleged speed?

Alleged speed?

81 (in bold it says Speeding - motor vehicle exceed 70mph on a dual carriageway - automatic camera device presumably that's the offence).

I'm guessing it's the average speed thing that runs all through there that got her.

A course will be offered, otherwise a 3 point £100 fixed penalty.

What is the date of the offence? Did you buy the car privately or from a dealer?

It was private bought and we sent the V5 off, not the seller.

Date of the offence was 6th May.

So if the details were updated on the 14th it was still showing as the previous keeper on the day of the offence.
