Posting on behalf of a friend, who overstayed his welcome in a car park - he'd paid up til midnight but left around 40 mins later. Sure enough he has received a charge notice. What's the latest state of play with these? Any grounds for appeal? Or offering part payment? Ticket was issued by Smart Parking, £60 rising to £100 after 14 days.
Have had a quick look on here - there's nothing immediately obvious that stands out that is similar to this. Thanks in advance! |

So you still have to host on this site? Like you did years ago? So many hoops to jump through. Why is there an attachment option, if you aren't able to use it?

looks like tinypic has been taken over by Photobucket so they may have killed the site to drive people to them and their intrusive adverts. The server is down.

Still not able to host picture. Can anyone give any advice at all? It is quite a basic case of someone staying in a private pay and display car park past midnight! Let's assume signage was clear etc!

At the moment it looks as though it is a usual Smart NTK where they don't mention POFA and therefore can not hold the keeper liable. Search for a BOGOFF response and post up what you will be sending, as the keeper. |

Yup, simply appeal that as they do not rely upon the Protection of Freedoms Act to pursue the keeper then they have no liability. Either cancel the ticket now or issue a POPLA code to be told to cancel it...

Smart Parking often cancel when they see an appeal from a keeper, not saying who was driving. Either mentioning the POFA, or just by using the template appeal here (PLEASE DO NOT COPY IT AND ASK 'IS IT THIS ONE?' - YES IT IS): https://forums.moneysavingexpert.com/showth...d.php?t=4816822 Very easy to beat Smart Parking. If they reject and issue a POPLA code, the keeper CANNOT LOSE, as long as they cite the POFA and are not naive enough to say or imply who was driving. Very easy stuff, on ALL Smart Parking threads you care to read on both forums, nothing new. |
