Hello all,
I received PCN on the 12.03.20 which I appealed. I then didn't receive anything until 05.06.20 when I got a charge certificate saying I must pay £195. I phoned and emailed the council, stating I wasn't given the opportunity to appeal. They have wrote back the following message; --------------------------------------------- Penalty Charge Notice No. xxxxx Date of Issue 04/03/2020 at 08:42 Location of Contravention Killick Street [South] Thank you for your email regarding the above Penalty Charge Notice (PCN) which was recently received at this office. I have to inform you that now a Charge Certificate has been issued, the time allowed for making representations against the penalty charge has passed. Despite that fact, I have looked in to the case and decided that the original Penalty Charge Notice was issued correctly and that there are no reasons which compel me to cancel it. I have also checked that we have sent out our legal documentation properly and on time and am satisfied that that is the case. The PCN was issued for failing to comply with a restriction on vehicles entering a pedestrian zone. I have reviewed the CCTV footage and I am satisfied that the contravention occurred. You have stated in your e-mail that you previously appealed this PCN and did not receive a response. Please be advised, our records indicate that we sent a Notice of Rejection in response to you on 28 April 2020. Please note, Notice of Rejections are always served by post to the address of the registered keeper of the vehicle. I do however appreciate that you may not have received this. I have attached the Notice of Rejection to this email for your reference. I have also attached an Environment and Traffic Adjudicators form. Please be advised, now that a Charge Certificate has been issued, the time period for submitting an appeal to the Adjudicator has expired. Therefore, if you submit a late appeal, you will need to explain the reason for the delay. It will then be at the discretion of the Adjudicator whether to allow the appeal to be heard. As you have stated that you did not receive the Notice of Rejection, I have decided to re-offer the opportunity to settle the penalty charge at the amount of £65 if received by us before 6 July 2020. However you should be aware that if no payment is received, the charge will revert to the correct amount which is £195 and the case will progress as outlined below. Our next stage is to apply to the Traffic Enforcement Centre at Northampton County Court to recover the charge as if it were payable under a county court order. We will then seek to pass the matter to bailiffs who we will ask to recover the debt. Please note that registration at the court and action by bailiffs will involve additional charges which will be added to the payment due from yourself. If we take this course of action, we will send you a copy of the court`s order which will provide you with details of how you may respond. ------------------------------------------------------------------ My original appeal: Dear Sir/Madame, I wish to appeal PCN xxxxx. Car Reg: xxxx There are no warning signs prior to turning in to Killick street from Caladonian Road. The signs are only visible at a point where its too late to safely avoid the so called 'Pedestrian zone' (which as the photos on the PCN show is full of parked vehicles creating further confusion). The signs are in fact past the junction where one would have to turn in order to avoid the zone. To turn left at the point where the signs are first visible, would cut across the cycle lane where cycles are allowed to go straight across (shown in attached images), this is obviously extremely dangerous and could results in serious accidents. Signs should give sufficient prior warning and allow road user to safely adjust their route. The sign on the left of Killick street is also obscured by a large tree, as shown in the attached images. It's not possible to read the excessive text on the obscured signage, check the current time and drive in a predicable, safe manner while being aware of other road users and pedestrians. The warning given and the signage is simply unsafe and inadequate. I do hope you consider the appeal and I strongly believe the above provides enough grounds for you to cancel PCN. Call the Traffic Enforcement Centre and see if the debt has been registered, contact details here: https://courttribunalfinder.service.gov.uk/...ment-centre-tec Thank you I gave them a call and they said its not registered with them yet |

Wow, I was looking around to find info on contesting PCN violations and came across this forum.... Because I have the same PCN!!!
Back on June 23rd, the signage is appalling. I have a clean license and haven't got any tickets for years because living in London you have to pay so much attention to survive using a car. My case is even more annoying because I was driving a Zipcar so they have already paid the PCN on my behalf and I have to pay £65 + £15 admin fee to Zipcar now. The really annoying thing is that I had a look on the schools website and it looks like it has been shut since the 20th March so why even need a pedestrian zone!! There are over hanging trees on the sign on the left, both signs at first glance look like the usual parking restriction signs, there is a whole load of other signs on approach. If you are approaching from Southern Street there is a fairly decent yellow sign at eye level pointing out the restriction but coming from Caledonian Road it is so difficult to notice, your eyes are going all over the place for the signs and your main concern is what is approaching me from the left. I have also appealed the PCN, I imagine they will bat it back in my face but I would like to keep fighting for this. As usual (one case per thread rule here), please start your own thread with above info, a timeline of events and posting copies of all paperwork/correspondence to and from Zipcar/Council. Use external site such as https://imgbb.com/ as space here is limited. N.B. Paying a PCN normal closes case with Council. I suspect your dispute will lie with Zipcar, but the experts here will know and will advise on your new thread. |

I still haven't received anything from Islington and the debt has not been registered with the TEC.
Is there a time limit on these matters? It's been over 4 months since the CC was received, and 8 months since the original PCN. It's quite annoying having this to think about this continuously. Also I have just moved home, shall i email to update the address and ask if they will be pursuing the PCN or just leave it and occasionally check with the TEC? Just keep checking with the TEC. In practice there is no time limit, but the longer they take the easier it become to argue that it's an abuse of process.

Thanks CP, I'll keep checking every 2-3 weeks for now. It's definitely an abuse of process in my opinion, if I don't respond in x days, I pay double and might have to go to court. But they respond whenever they like with no penalty
