Hi everyone,

I recently got a letter via a post stating that my vehicle was in a client's property for nearly an hour. Its got a picture of my vehicle at the front and back with a very poorly shown registration number. A bit annoying because the van in question was delivering during this time. Anyway, the date of this notice was sent to me more than 14 days after the van was in this property so surely I can email them a letter right? I'm unsure on how to do this however. Hope you guys can help

EDIT your post to avoid identifying the driver. refer only to 'the driver.' This is CRUCIAL.

Then, to Highview:

Dear sirs,

PCN xxxxxx

I write as the registered keeper of the vehicle to which the above PCN applies. There is no legal requirement to name the driver and I will not be doing so.

Your PCN arrived far too late to hold me liable as keeper under PoFA 2012 [look it up and type it in full] and I require you cancel or provide me with a POPLA code where I will arrange for you to be instructed to cancel it.

If there is an E mail address, use it. The record to beat for cancellation at Highview is two hours!!!

I am challenging this Parking Notice

1 It was sent too late to meet the conditions of the Protection of Freedoms Act 2012 to recover payment from the registered keeper
2 The driver had an implied right of access for the purpose of making a delivery to the Principal and had no obligation to have regard to any signs displayed by your company

Please cancel the Notice or provide the access code to refer the matter to POPLA

The driver is never revealed. Call them “the driver”

If it took more than 14 days to arrive they cannot use pofa to hold the keeper of the vehicle liable, but the driver still can be.

As this is high view, send the standard MSE FORUM APPEAL, that you find in the newbies thread (easy to find) there and they cancel, usually same day.

Ok I already did the email but no reply from them as yet so far so unfortunately they I haven't broken the 2 hour record lol. I keep you guys updated. Thanks for the help

My email is paste and copy from others. The email is something like this...

'I believe as the PCN did not arrive within the stipulate period of 14 days, as specified within the POFA 2012, you have failed to meet the strict deadlines to transfer liability to the keeper.
Therefore, there will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge'

SO its not the exact template as given over at MSE?
Is there any chance you could STOP identifying the driver? Do you understand that this is something you are NOT TO DO?
