I was stopped by the police with a speed gun 8 days ago now for speeding, I was spoken to at the scene and had to give my details to the officer which was address name DOB and showed him my licence. The car I was driving was a hire car so I am not the registered keeper of the car. Now my question is will they still get a NIP even though the officer took my name and address as the driver and cautioned me and told me I would be reported for the speeding offence or would it be sent to my house as the police know who was driving the car? Some people have told me that since I was cautioned at the scene this counts as a NIP and the registered keeper nor the driver will get one? If this is the case what will be the next thing I receive? Who do the letters go to if my details were taken and I was caught in the car by the officer speeding
If the next thing I will get is a FPN how long does that take to come through? I was caught doing 45 in a 30 if this helps Thanks |

Just a nervous wait now to see if they actually do send it to me and not the RK đđ The RK has no involvement with this. He or they would only be in the loop if the driver was unknown. The RK would then be the first port of call in the effort to establish who it was. The FP offer will be made to you. |

Quite, aside from anything else the police have no legitimate reason to contact the RK in a case like this, so it would be a breach of data protection for the police to inform the RK that the driver is suspected of a crime. It's literally none of the RK's business. Thanks for your replyâs and adding some clarity to this! I just hope I get something through next week! I will accept the Fixed penalty straight away & then I can finally relax and stop worrying about the paperwork going to my work! đđđ

On the anticipation that a COFP does indeed arrive in due course read it carefully as to what you must do to accept it.
It is quite common for people not to send their licences in as requested. |

Hi guys..
I have received my FPN through the post today which is a great relief, on the form it does not state what speed I was going all it says is âfor the alleged offence speeding - exceed 30mph on restricted roadâ Shouldnât it say at what speed I was going? |

No. Why does it matter? Youâre either within the range for an FPN or youâre not. Clearly you were.

If you're looking to get off on a technicality, that's fine but you should understand that the few technicalities you can potentially get off on tend to require a great degree of attention to detail to exploit. The fact that you think and have told us that you have received an FPN is not encouraging.

Just to be clear, you havenât paid an FPN, you didnât have one, you had a CoFP, that was Andyâs point about accuracy.

No. In effect there are three ways to receive a fixed penalty Most common is the conditional offer that you have and itâs how those arising from cameras or via a traffic offence report will be given. There is the fixed penalty notice which you only get by surrendering your licence and that will be by an officer either at the roadside at the time of the stop or later in a police station Which brings me to the third method which has no formal name but is often referred to as a âprovisionalâ fixed penalty which is a notice received at the time of a stop and requiring you to show your licence at a police station, if you then surrender your licence that provisional notice then magically morphs into a fixed penalty notice and is handled the same way from that point. If the police give you an FPN they have to honour it even if they shouldnât have given it to you (such as you being on 9 or more points) that does not apply to a conditional offer as one of the conditions of the offer (to accept it) is that you are on 8 or less points So as you can see a CoFP and an FPN are actually very different although the punishment is the same. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
