Hi all,
Basically the driver received a parking ticket for overstaying in a private car park, but when attempting to pay online, it says that it cannot be found. Likewise when typing in the PCN number to pay over the phone, it states that it cannot be recognised. This ticket was received a week ago (stuck to windscreen) so it should be in the system by now. On the ticket, the warden has missed a digit out when typing in the number plate. When trying to pay online, both the incorrect and the correct version of the number plate was used when trying to pay but both didn’t exist. The warden did however take a picture of the number plate after issuing the notice as he did this with every other car on the car park. All other details on the ticket are correct (e.g. car model, colour etc) There is now a week to pay the reduced rate of £45 instead of £75. Please help! Unable to pay! What company?
DONT PAY YET - almost certainly this is privat eparking, and the failure to record the correctnumber plate means the KEEPER cannot be liable, as there is NO POSSIBLE WAY for them to comply with POFA - as the notice to keeper must exactly repeat the info on the notice to driver, and as the VRM is wrong, it cannot do so. |

OK, so now youve had a look around - have you seen what appeal avenues are open to you, what you do when the appeal is rejected (and why they reject almost all appeals!)?

The driver has 28 days to appeal to the company. If that fails, you must either pay the full charge or get referred to POPLA appeal service. They reject appeals that have definitely contravened the parking regulations regardless of poor signage or being able to comprehend entering a contract.

First Parking may reject appeals based on poor signage but it doesn't mean that POPLA will
The point is that you must not appeal the windscreen notice but wait for the Notice to Keeper to arrive You can then include in the appeal that they've failed to meet the conditions of POFA |
