Parking charge notice (hospital) - date query etc, Is this a legitimate claim?

Yesterday, I received in the mail a Parking charge notice from Parking Eye who operate a private car park at our nearest hospital. This is the first contact Ive had with them, so from what Ive read thus far, this is referred to as Notice to Keeper?

My immediate thought was to just ignore it, but looking at this letter again, there seem to be a few queries. If Ive read the rules correctly, they must send the notice within 14 days of the incident if no prior ticket was issued, or within 56 days if a ticket was issued. I take it I have this correct?

If so, then this claim is invalid on both counts - the incident is listed as 21 June, 12:40 to 13:17. The issue date is 16 August.


If Im correct here, should I knock up a letter informing them its invalid for these reasons, or should i just ignore it?

Im tempted by the latter, but i dont want to do so then find out later its too late to appeal if things gonawry. If things do go awry, I dont even know if i was driving at that time or not (this is a hospital i was visiting frequently until recently) but so has my wife. My memorys pretty **** due to the tablets i have to take, and any hospital appointment letters get binned once theyre done, so i have nothing to check back on. If push comes to shove, Id be more inclined to take it on the chin and say it was me, but is it not reasonable for them to prove who was driving? Am i under any obligation?

I can happily provide a photo of the letter if it helps.

Edit: It is an ANPR type notice - two photos of the car. One front facing at time of arrival, one rear facing at time of departure.

Indeed, you cant sk "ahat is POPLA" at this point - its all over this forum
Completed cases is a good shout
Dont look for precisely the same circumstances, as usually the undefdrlying issues are the same. Dont blindly copy and paste, either.

I meant no offence.
I only asked because my memory tends to be a bit wobbly due to various disabled issues.

All i meant was, what should i expect next.
Thats it.

Of course, ive taken the trouble to read through various things on this website, but you have to appreciate that its reasonable for most people to not grasp everything, and ask questions.

As i said, i meant no offence, but im going to ask what you might thinkare daft questions because this isnt my field of expertise.

I have. Spend a few hours a few weeks ago when i posted this, but my memory doesnt work that well, sadly. Its just how it is.

Also, i didnt ask what is popla. I asked what the popla code is. I wasnt sure if that was something entirely different.
So, as ive just had another nosey, i just wait for the details from the independent arbitration, yes?

In any case, thanks once again for everyones help and understanding. I truly dont wish to offend. Im not doing this on purpose or as part of laziness.

Oh. I was following what a previous user had said to me (ostell, in post #19).

Just to be clear, all ive done is what has been advised here - rejected their claim with a letter to Parking Eye directly, and received this response.
If i was also supposed to appeal to popla then ill get on that now?

Is that correct?

Edit: Double checking, the letter i detailed says if i dont respond they will issue a popla code. So which should i do? Wait for that code from them, or start a popla appeal myself?

Youre going to get a rejection as PE reject everything.
So you can write your appeal now
As you WILL get a code
You cant actually submit the appeal until you have a code, of coruse.

You have to wait for the code. You can start drafting the appeal text but cannot submit it without a code.

You've misunderstood. You appeal to PE and when they reject, as they will, then they give you a POPLA code and then you appeal again to POPLA using the code

They have 35 days from when you submitted the appeal to respond, there is no 28 days to wait out at all, that 28 days was for you to respond to them!

Start preparing that POPLA appeal, you WILL need to use it.

I appreciate your input, rookie, but please note the letter i detailed (their response). They have the charge on hold for 28 days after which theyll issue the code.

So i can either provide them details of the drivers, which is impossible as i dont know whether it was myself or my wife. Or i can wait the 28 days for that code and then submit the appeal.

I have my appeal ready and complete.

I dont see what your point is, to be frank. I already responded to them, obviously, which caused their letter. I have to wait until i get that code to appeal so im unsure exactly what youre asking of me.

He's mostly saying that your appeal should be responded to within 35 days - their deadline of 28 days doesnt mean anything to
WHat does matter is your POPLA appeal, and it was acting as a reminder to get his done and finessed.
