Just a bit of unnecessary background..
My father is critically ill in a rehab ward of a hospital. The hospital car park on the day in question was heaving and the person driving my dads unused car that day had to go for a meeting with specialists about his health at 2pm. After looking and waiting around the hospital for 15 minutes, they decided to take to the streets and parked quickly at the nearest point where the double yellows had ended. Unfortunately my father now has a parking ticket as they say his car was parked close to a drop in the kerb. The drop in question was the entrance to a homes driveway. The car did not block the actual driveway one bit as it was much smaller than the drop, and only the very back of the car can be said to be in-front of the drop. I have appealed the fine, and asked for evidence which was sent. The questions I have are: - If I completely ignore this now, what are going to be the repercussions? The car is in my father name. He will be in Hospital for a minimum of 3 more months possibly longer, and will probably never have the mental capacity to drive or defend himself in court. - Do I have any grounds to appeal the fine on the drivers behalf? I park outside my own driveway for example every day, and always have. I have never thought about there being a drop in the kerb and an overzealous warden may come down the street. - The evidence is really shoddy. However I am assuming their actual evidence will be of a much higher standard. The kerbs all down the street are in disrepair due to the trees growing in the pavements. I have attached evidence and would be really grateful for any help. |

Thanks so much for the advice. I just rang and was told to appeal as soon as possible in an email as the next letter is due to come on the 14th and I do before then it can be considered. Do I have any grounds to appeal?
I can send by email today if so. |

Write to the council with medical evidence as to you dad's condition, and ask that the council exercise discretion to cancel the penalty. You should also tell them that the car is in the course of being re-registered to someone who is able to discharge the legal responsibilities that go with car ownership. If the person driving the car was you, just tell them, unlike private parking companies there's no benefit in concealing the identity of the driver for council PCNs.
If you have a lasting power of attorney or some other legal authority to act on your dad's behalf, include a copy of that as well. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php
