My story:

I parked my car on Tuesday (21st March) outside 13-15 Hornsey Lane Gardens. I have a Haringey parking permit so regularly park in any space in and around this street I can find. As far as I am aware, there was no clear signage on that day (21st March) and definitely no cones to indicate that parking from 22-29 March was prohibited outside 13-15 Hornsey Lane Gardens. The usual practice on my street is that there is clear signage and cones to indicate where one cannot park due to contraventions.

I have been slapped with two parking tickets - £65 x2 fee (23rd and 24th March) and my car was towed on 24th March (£200 fee). The price of all of this is £330, and is a bit of a joke really. I left my car for less than 72 hours in a spot with no clear signage of parking prohibition and I've a £330 bill as a result. I paid £265 at Haringey car pound on the 24th to get my car released. They advised that I appeal through the council. Currently I have a £65 bill outstanding for the first PCN dated 23rd March.

I've appealed on the Nextdoor app to see if anyone on my street has any CCTV footage from Tuesday (21st March) that would show how clear the parking contravention signage was. To my recollection, it wasn't clear and this is the case I want to put forward to the council. The PCN photos show the signage on the 23rd and 24th but I am not sure the signage was clear on the 21st. I am also aiming to lean on the fact that I have a clean driving record (no points, no unpaid fines), the cost of living crisis, and the fact that I didn't leave my car for long at all before they decided to tow it.

I'm wondering what my best course of action is. Can anyone advise me on this please? Thanks in advance!

As per the section read this sticky you need to post the materials: PCNs, everything you were given at the pound, and council pics.

That isn't the correct contravention which should be #21 Parked wholly or partly in a suspended bay or space. I very much doubt that Haringey properly advertised the suspension either as they don't in order to save noney.

You haven't shown us any form that the pound should have given you telling you of your right to make representations. Was there any other piece of paper?

Don't pay the second PCN, we need to challenge it. You will only beat the PCN by risking the discount at the tribunal but I have an excellent record against Haringey. In 2022 they cancelled 7 at the informal or formal stages and I beat them 4-0 at the tribunal.

All advice given by me on PePiPoo is on a pro bono basis (i.e. free). PePiPoo relies on Donations so do donate if you can. Sometimes I will, in addition, personally offer to represent you at London Tribunals (i.e. within greater London only) & if you wish me to I will ask you to make a voluntary donation, if the Appeal is won, directly to the North London Hospice.

OP--we need to see the PCNs and also the forms you got from the pound especially the one which shows you how to appeal.

Otherwise we have no idea what the contravention is.

Additionally, you should down load the Councils photos which should be on their webpage for "paying/appealing"

Thanks for your reply mate

The pound pointed to the back of the PCN(s) (I've just added a photo of this to the Google Drive link; PCNs > Back of PCNs.jpeg) for how I should challenge the PCN. There was no other piece of paper

Hi Mick,

Cheers for your reply. I'm not sure how to delete this post; I've made a new topic which has a Google Drive with all of these photos and information here >> http://forums.pepipoo.com/index.php?showtopic=149171

Thanks,
Dingo

OK, I'll ask a Moderator to combine.

The Temporary Traffic Order should still be up. Can you get a better photo?

I would say this is a continuing contravention so this one might apply:-

Dadt question - why do you need CCTV of the signs when you live there and can walk out the door and have a look?

I am looking for CCTV footage for the day of me parking (Tuesday 21st March). I can see the sign now, and it is visible in the photos I've attached but these are dated from the 23rd and 24th March which is not when I initially parked. Hope that clears things up

The OP tells me he received a cheque from Haringey yesterday for £265 - am waiting for a copy of their Notice of Acceptance.
