I think it may be a separate case but the OP is all over the shop and not posting clearly.

Dates and council seem to be the same.

Lewisham and Greenwich ?

The Greenwich one regarding a refused OOT and proposed N244;

The latest, Lewisham, being a successful OOT, just querying next step.

Original thread opening post:

You need to remember if you paid or not. Pay & Display machine? Did you receive a ticket?

They wrote on the fine that the fine is valid even without evidence is this true?

You drove away so it'll be the CEO's word against yours. You don't seem to deny you were there, and we won't suggest you lie.

OP. The evidence of the contravention will be the video, not a zoomed-in still image from the the video.

So post a link to the video.

QUOTE (Mr Meldrew @ Sat, 17 Feb 2018 - 15:59) *
For what it’s worth, I think the OP should consider whether the Authority has acted beyond their powers by installing the signs, if contrary to the intended warning prescribed by the regulations, especially if there is not the unusual degree of danger described by the sign.

According to the Manual, (3. Legal…) illegal signs on public highways are an obstruction and the possible consequences of erecting or permitting the erection of obstructions may be severe for those responsible and could lay themselves open to a claim for damages for example, if the obstruction were the cause of accident, or of injury in a collision.

But does any of the above trump knowing of a stationery obstruction and driving into it?

what to do?

Your choice - take the CoFP or lose that option and go to court. Same points but bigger fine, costs and surcharge.

Is it an urban myth that sometimes they don't follow up the ones that aren't returned within 28 days and you get away with it?

Almost unheard of these days. Everything is computerised so very rarely do any fall out of the system. IMHO, not worth risking 6 points.

So you knew the signs were there... You forgot the signs were there... And reversed into one...

Why would the council be liable?

Just want to check all is present and correct before commiting to points or a SAC

Remember any photos supplied at this stage are to identify the vehicle, not prove the offence.

Why not post in the Flame Pit and discuss.

I'd say baby was being breast fed on demand, which is not predictable, and caused an unexpected delay of say 10 minutes when everyone else was ready to be picked up. End of story.

Excellent idea...

What did your employer say when you complained that one of their permits had been disregarded?

Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes

Please confirm name and address on V5C is EXACTLY correct, and the DOC REF DATE on page 2.

I want to avoid the points (if possible) but clearly don't want to make things worse. Is it enough for me to send in the drivers details that are requested on the form without using the form itself or are there blank ones I can download and print off or something? If i send in the details can I do this without accepting the fixed penalty and the points?

Thank you

It doesn't matter who was driving - it was your car at the time?

Seems only yourself to blame - forgetting about it instead of dealing with it. Best to pay it?

And what happens if I don't have or can't put together the £90 (or any other 'fine' ) ??

You could always stop putting fuel in your car until you've paid the SAC or fine....

I was unaware that my address needed to be updated separately at DVLA as they're under the same umbrella.

There is no link at all to a V5C and a DL. Entitrely separate entities.

A complete lack of flexibility or consideration !

Not really. Owning and driving a car comes with responsibilites. Same for all of us.

It goes to court. Points, fine, costs. But time to pay.

Obviously you'll pay in the end since you have enough money to run a car. But there is no option to pay in instalments if you take a SAC or CoFP.
