Hi

I have got a ticket posted on my windscreen in April and during that time I saw the man.

The ticket was upside down so, the man was not able to see it properly hence put the PCN.

But I shown it to him and he said I will update the system saying have seen the ticket but you will have to appeal to cancel it.

Which I did by they came back saying it is rejected as signboard clearly says it should be visible.

Below letter I posted in appeal:

Subject: Wrongly Parking ticket fine attached to the vehicle

This is regarding the Parking fine posted on my Vehicle parked in Hounslow (on VFS site). The Parking ticket was shown on dashboard but seems Ticket Checker had difficulty to view it. We discussed with the ticket checker and shown him ticket immediately. He agreed the ticket is right and valid but I still need to appeal to eliminate this charge from your System. Hence, below is detail :

Parking Ref no
Reason: There was valid Parking ticket there and shown it to ticket checker. He wrote a note into his system already. Please check and resolve this issue. For your reference, I have attached the ticket copy to the appeal letter.

I have already spoken to my Solicitor friend and he agreed as you have a proof of ticket with last three digits () of car printed on it. Which prove you paid valid car park charges. Hence, requesting you to act on it immediately and cancel the charge.

As usual, for best advice please post up PCN (both sides), the rejection letter and any Council photos.

Do not attach docs/photos, but use this method:

for how to do it. I use Tinypic for stage 2 with no problems.
STAGE 1 takes care of resizing. If you use Tinypic for Stage 2, on the left each image in Tinypic is a list of links. Highlight and copy the entire link 'for forums' from the list for each image - beginning with IMG and ending /IMG (include all the square brackets [] ), and paste each link into your post. Each copied and pasted link will embed a thumbnail link in your post.

Using the attachment method is not advised as it means quickly running out of attachment space.
Redact/obscure personal details, PCN no. Reg No.

Also post up a GSV (Google Street View) link to the location.
LEAVE IN all dates/times; precise location, Contravention code and description.

Is this a private or council PCN if private ask a mod to move to correct forum

either way post the PCN redact any personal details

When you say the ticket was upside down, do you mean face down or the operative had to turn his head to see it, a difficult procedure in the absence of an evolutionary neck ?

Valid argument for "promissory estoppel" in the event of legal action

The driver is entitled to rely on the operative's confirmation that the ticket was valid and his assurance that the parking notice would be eliminated after it was appealed

You've acted reasonably

You will only weaken your position with a so-called independent appeal to the IAS where the motorist has no chance
You would only hand UKCPM a decision to wave in court

Ignore everything now short of a Formal Letter Before Claim

A rejection was inevitable - they are not in the business of accepting appeals as there's no income in that!

Here.

I would say you have a better than 50% chance of winning at court but you would have to dance their tune in terms of paperwork and deadlines and attend court. Small claims can be unpredictable.

A picture of the sign at the location is essential here. You did display a valid ticket but it all depends on the wording on the signs.

A GSV location may help too.

True, not easy to see signboard via google.

I bet there are lots of people suffered PCN there. They don't have their own people patrolling to check tickets but paying commission of 10 pounds to each who do that & upload the photos to their site.

Moreover, their Parking Ticket does not have their address written which I found by googling and wrote them about the incident.

Do you think a further reply to their letter required?

A valid parking ticket was purchased (proof of receipt attached with my last letter) therefore no financial loss has been incurred by the landowner as a result of this incident. Therefore, I feel that the sum you are seeking is not a genuine pre-estimate of loss and is unconscionable under the circumstances and as such it amounts to an unenforceable penalty.

Please cancel the ticket immediately and confirm this by return letter. Alternatively please send me a POPLA code so that I can get them to cancel at your expense.

Stop harassing people especially when your ticket checker checked the ticket. See your system he has updated it in front of me. Please provide me the name of the land owner to which I can complain about your company. The paying & display machine do take last three digit of the Car reg. Hence, you should have technology to check system before issuing the ticket.

Moreover, please don’t expect any payment from me as this is not ethical. You can’t ask payment for no reason.

But it WILL get to that point. UKCPS are very letigious so expect this to go to court if you aren't able to ward them off beforehand.

My gut feeling is that you should be prepared to take the discounted offer (if it's still on the table) or push them to the point of exasperation.

If you are up to a court appearance if all goes badly for you, then now's the time to start a dialogue about the situation.
Fortunately you haven't really identified who the driver was so you can work from that angle for now.

They have logo of BPA in their letter but I doubt they are member.

Second thing I don't feel have done any mistake. If I paid for their parking and shown that ticket to their attendant though it was after he put the ticket . On that ground I don't feel like paying anything to them. Yes, if I wouldn't paid parking charges then would have felt I have done something wrong.

Going to VFS office picking two kids with me. You tend to do mistake by overlooking. But I did pay them for Parking.

Same thing happened in Mac D but condition was different. I spoke to them and they straight way cancel the ticket. Also, in Tescos.

So, I wanted to complain their Land owner. Not sure how to find him

Google is your friend there

They dont care about right or wrong. They want your money. Nothing else. Ther eis no reasonable appeal you can put togheter that will put them off.
