Received the following which has misspelt surname

Wanted to know if this provides any grounds for appeal?

A NIP is not something that can be appealed, it is a notice. Is it a minor error so that it is clear you are the intended recipient, or does it make the name something different from your own? Are you the registered keeper of the vehicle concerned, and if so is the error on the V5C?

As the timing suggests you are the registered keeper of the vehicle, the first check, as pointed out above, is to check if it’s merely copied an error on the V5C (which is likely).

If the surname isn't significantly different and the V5C is correct, worst case scenario, you should be offered a course at that speed.

Thanks I will check the V5C, what if the driver has done a course already within 3 years, thought this would mean points rather than course offered?

Depends on what course was completed, you can only do one of each course every 3 years (based on offence dates - so a course completed 3 years ago toady would be dated against the offence date which would be at least 6 weeks prior to that).), noting their are 3 different speed awareness courses (conventional, 20 limit and variable speed limit).

As Rookie says, it will depend on the course, but for a basic speed awareness course you are correct.

Have you done any courses in the last three years?

The V5 has been checked and surname is spelt correctly on there, so think it is an error generated on their part

Will check with driver what the previous course was and when

That is unusual - but is highly unlikely to provide a defence. What's the nature of the error?

...but it could be queried and there's a minute chance they could cancel it based on 'embarrassment'...

Thanks for your reply, they have spelt surname incorrectly on the notice sent, would I fill in on the back the correct name or query it in another manner?

Call them up or write a covering letter would be the two ways I could think of drawing attention to their error

Yes, but letter dropped, added or letters swapped?

Does it really matter? From references to the "the driver" I assume the OP is the registered keeper but was not driving at the time. So long as he gives the correct name for the driver, I don't see that it matters if the S172 request had an error in his own name.

More out of interest to understand what the 'error' could be.

Yes, it appears the OP wasn't driving but the 'embarrassment' option is still a long shot.

Indeed at the very least the OP should name the driver (Spelt correctly of course biggrin.gif )

Not sure what you are implying here, I have simply stated what I have been told

Thanks for that , so would you say also not worth mentioning about the incorrect name the notice was sent to?

The implication really being you weren't caught doing 34 in a 30 - so why tell an untruth here and if you're sparse with the truth on that really quite insignificant fact, is everything else 100% honest.
