PCN Dispute - Advice Required, Bank Park Management & IAS

Hi,

First time poster here looking for some advice please.

I have been issued with a parking charge from Bank Park Management for failure to pay at a site (Farley Centre, West Bromwich) which uses ANPR. The apparent breach occurred on 11/01/2019 between 22.31 to 12/01/2019 00:28.

At this point, I have not identified the driver and the initial PCN was addressed to the registered keeper (myself) at a previous address.

As the registered keeper, I have visited the site since the breach and I have appealed to Bank Park Management on the basis of poor signage, no signs at all on the site to imply that the car park is chargeable at all times (other than on the one pay machine tucked away at the very end of the car park). I have also advised them that on the day of the apparent breach, none of the street lamps within the site were switched on which reduced visibility of any of their signage being seen which is clearly shown in their ANPR picture they have provided. They have been informed that on entry to the car park, there are no signs to indicate that the car park is chargeable at all times either.

I have been to the site to take photo's and video to support my appeal which shows that their signage is poor and not within reasonable distance and in all cases unclear.

Unfortunately the appeal has been unsuccessful to Bank Park Management who have advised that I can now either pay the fine of £60-100 or appeal to the IAS. I have within my appeal offered to pay for their financial loss of 2 hours of parking which is 80p to which they have refused.

I have read on this forum that the IAS works alongside Bank Park Management and there seems to be no point going down this route. Either way, I have exceeded the 21 day period where I could appeal via the IAS so will not be going down this route.

At this point it would be greatly appreciated if I could please get some advice on how to deal with this situation going forward. I appreciate that I may have missed out some information which I will need to clarify in order to be assisted. Below you will find all documentation that I have received and sent between myself and Bank Park Management;

The reply to my appeal as below;



At this point, I have not appealed to the IAS and I am outside of the window to do so. Please advise the best steps to take forward from this point as I do not agree with the charge and feel that Bank Park Management are not being reasonable in their decision and are trying to cheat me out of money which they have not lost. The financial loss to them has been 80p which I am happy to pay.

You have two choices

1) pay
2) See ig they issue a court claim, and defend if they do so.
