Hi everyone
First time posting on here , need help please. Ticket is from Highview Parking. The driver parked on 11/5/18 at 14:27 and stayed until 17:16, so for 2 hrs 48 mins (48 mins over the 2 hr limit). They say the driver now owes them £100. They are asking for the drivers name. No replies have been sent to the 2 letters they've sent so far. Slightly worrying - they cite a Supreme Court ruling of Parking Eye v Beavis and that a PCN on Private Land is enforceable. Can this be fought? Many thanks in advance for your help. First of all edit your post so that the identity of the driver can not be inferred, use "the driver......" etc. Your reading of other threads should have told you this. You have read other threads haven't you?
You can possibly fight this but we need some information, such as the first letter, the Notice to Keeper, you received posted here, with identifying details redacted, but leave dates. A simple overstay of free car park is probably very Beavis relevant but as HV don’t do court it’s definitely a hollow frightener.
They usually do not comply with Protection of Freedoms Act and are easy to beat at POPLA if they are intransigent in appeal. But ignoring them is not the approach as a missed appeal window will see a barrage of threatening mail. Best to get it cancelled, if it’s not too late! What sort of car park is it - can a shop help if there are genuine reasons for the overstay?
