dcb legal threatening to take to court

In December I was attending a fight night event and was directed to an area to park. However as I went to the place I was directed to I realised I couldn’t park there. As a result I was sat in my car for about 2 minutes while I found somewhere I could park. In this time a man took a picture of my car and I was later issued a ticket. As this was a private parking I ignored all the letters they sent me. I have now received a letter from their solicitors dcb legal threatening to take me to court. I was wondering if dcb legal are known for actually taking action or this is still an empty threat and I should still ignore.

Unfortunately this approach has not been wise for about 10 years now.

When you say threatening, what does it actually say? Is it marked "Letter Before Claim" or similar? If so, it's definitely not an empty threat.

Let's see the original notice you received, both sides, dates and times left on, personal details redacted. For a stay as short as you describe you could make the argument that the driver read the terms conditions on offer, chose not to accept them, and left. It would help to see the signage too.

Yeah. Not enough relevant info

DCB legal do nothing unless instructed to by their client. So , who is that?

Ignoring has been a stupid response since 2012 and definitely since 2015

1) extremely foolish , you left them no choice, other than debt collectors followed by court ( very common )

2) very , very common

3) definitely, especially if their client instructs them to do so , but usually an LBC with 30 days notice to settle precedes any court claim via MCOL

4) definitely not an empty threat !!

We need to know a lot more, plus see pictures of signage and redacted pictures of the letters, hosted on imgur or similar ( file hosting site )

Okay if that is the case, if they were to take me to court do you think I would be in a strong position with my case? And also if zi list would they add extra fees that I would have to cover?

4) New generation parking pcn and an LBC giving 30 days notice etc

5) unknown without much more information and pictures as mentioned above, if they can convince a judge , you lose , if not , you win

6) definitely, typically around £120 plus the original PCN charge, so usually around £220 in total

If you fail to do so they will raise a claim and make the case you are behaving unreasonably.

There are dozens of lbc responses on here

Are you there for exactly 2 min? Is that what the original notices state?

They`ve already added extra fees that they know they cannot claim for (debt recovery).

Photos of signage needed which will be crucial and copy of the original PPN with personal details redacted but leave dates.

You first post identifies the driver. Pl amend so that the the driver is neither stated nor able to be inferred.

Does the keeper still have the previous notices and correspondence?

If not, then you'll need to obtain these. You, as keeper, will be guided as to how to do so.
