Hi there,

I am looking for some advice as I am stressed following a notice of enforcement which I have received from Sandwell Mbc due to being in a bus lane.

Upon receiving this notice we contacted the council and told them we did not know why we had received this. We were told they were 53 outstanding PCN notices unpaid. Which I was very alarmed about.
We moved address in March 2016, we notified all relevent companies ie council, banks, car insurance and so on that we have moved. We did have redirection on for 3 months but then advised our tennat to jsut let us know incase we get any other post which she thankfully continued to pass to us. It only came to light that we had not updated our address with DVLA when our tennat forwarded us 2/3 PCN. Which we contacted the council told them situation and it was agreed we could pay the lower rate. At no point the adviser mwntioned they were 53 outstanding tickets. Had we known at the time we could have taken action to prevent escalating. Anyhow we informed DVLA chnaged of address they sent updated log book on 1y/6/2017. We have been told by council to file a TE9 form ro prevent further charges and then submit an appeal.
I am going into citizens advice tomorrow to get legal help on where we stand. My argument is where have these 53 PCN gone which council saying they have sent. Surely normal process would be that you get minimum of 2 reminders if PCN is still not paid. Then final notice and then warwick before it escalates to Enforcement lwtter. To me were looking at over 100 to 150 letters should have been coming out. However to find out of those we received 2 only. I find it very hard that these would have been thrown away by tennat when she gave us all our other letters which came through.
So this said looking for advice on how to submit this TE9 form and whwhere I stand.

Apologirs for late reply. We did speak to council about the 1 with Bayliff action. They said we have to follow the process for appeal which filing the form which we have done.

We filed the Pe3 and Pe2 and have not received a response yet.


Fair enough.
A little time left yet for any objections.
Question is whether or not council will object.
Given their "fair" stance on the others, hopefully not.

So acting paid off.

Sorry if my earlier post upset you, but now you can see the benefit of getting the authority back in the loop.

As your submission to TEC was a little while ago, did you ask the authority (who you can presume have now been contacted by TEC) whether they have lodged an objection?

Hi, an update received letter from council yesterday which is a copy of documents they have submitted into county court rejected the Out of time wpplication. Where do I stand.

We also spoke to the tennat she said she did receive some notices but we were not living there she returned them back to sender.

But she there were never as many as we were asking about.
