Hi I used the paybyphone app to park in Newcastle and typed the first few numbers of the location code and selected a previously used location (8104) rather than the correct location (8100).
I now have a £50 pcn ehich goes up in 14 days to £100. Shall I post a picture of it, it seems fine. But I feel I have a case as the app almost led me to choose the wrong location and it was a technical error and as I did pay for parking in a Newcastle city council car park they could let me off? Any advice on how best to proceed appreciated. |

OP---has the Council been deprived of its money?
Probably, for that location but not overall. Were the parking rates the same for both locations? If so, I would send in a challenge to the PCN explain the circumstances and ask the Council to exercise its discretion and cancel the PCN because of a simple error and that they have not lost income (you did pay into their coffers). Don't argue that the system is not fit for purpose, that'll get their backs up. Mick |

Hi Mick, thank you so much for a quick reply. The car park location I used was slightly cheaper so I paid £4.54 instead of £6.14, so I owe them £1.60 which I’m more than happy to pay for the error. But thank you that’s good advice to not argue about the system but explain and offer to pay the difference? Thanks again

Newcastle say it's your responsibility to check location number and there is no reference to pay by phone mistakes in their discretion policy. But we do see councils cancelling for a first mistake like this so you must ask. It's unfortunate that the rate for the other location is lower.
Post the PCN in any case. |

Thank you, I do use the paybyphone system all the time and it is a first mistake so worth trying, thank you. Do you think it’ll mean I’ll emd up paying the £100 amount though as they won’t get back to me within the 14 days?

They will reoffer the discount if they reject.
