Thanks guys, I have edited the original post so as not to incriminate the driver and I will appeal as keeper next week.

Is it important to mention that I am not the registered keeper and the vehicle is written in my aunties name? Should I follow this procedure despite of that? Should I appeal on behalf of the registered keeper? I'm way out of my depth here I feel.

Hi all,

I really need some advice and having read similar posts here, it seems like you guys will be the people to ask.

Last Thursday the driver of my vehicle received a PCN for unknowingly parking in a private permit holders car park. The PCN has been served by Spring Parking who say they are acting on behalf of a private client. I believe them to be working on behalf of the National Youth Theatre in London however my issue is that their car park is also shared with a block of apartments, one of which the drivers friend lives in and whom the driver was visiting when they received the PCN.

The car park is gated and you require a key fob to gain entry or (like the driver) you need one of the occupants of the flats to buzz you in. The driver parked in a numbered bay which their friend assured them they rented along with their apartment and left the vehicle there over night. The driver came back the next day to find a £95 PCN on the windscreen for parking without a permit.

As I have said, I am unsure if Spring Parking are working for the private apartment company or the NYT and as seems consistent with my luck of late, the drivers friend is unable to find his copy of the housing contract. For the sake of argument, if it turns out the driver has parked in a space not belonging to their friend, what should my plan of attack be? Should I cough up the money or do I have a decent chance of beating them at the appeal stage?

Details:

The driver parked in 1 of 6 marked and numbered bays (which they presumed corresponded to the apartment numbers) only two of which were occupied, and there was a sign displayed on the wall next to these bays however, having been assured that they could park there by their friend, they didn't notice it until they received the PCN. They have parked in that spot numerous times before and received no such fine.
