That's not mitigation, mitigation are factors that reduce the seriousness off the offence, i.e. light traffic, good weather conditions, lack of hazards etc. Saying she wasn't concentrating is more of an aggravating factor. In reality I suspect there is little she cn say that will change the outcome. |

You are supposed to slow down to the new limit before you enter it, there is no grace period. Likewise when going from a lower limit to a higher limit, you are not supposed to start speeding up until after the new limit has come in force. Is this a random question or does it pertain to a case? |

Court of no court there has to be some kind of letter within 14 days asking who was driving. There has to be a NIP served on to who the police believe is the Registered Keeper within 14 days. This will also include a S172 request for the name of the driver. I send that back and then either I get a FPN or a court summons if takes forever to come back? Is that about right? You will either get an offer of a speed awareness course, a Conditional Offer of a Fixed Penalty or a Single Justice Procedure Notice. |

Lanes don't have individual speed restrictions, only carriageways do. So, if for some reason, the gantry display on one lane is blank but the others show a lower limit, it applies to the whole road. |

Do the photographs show that your vehicle moved between the first and second, if so then if the light was red the offence is complete. The 0 MPH on the NIP is a red herring, they use the same template latter for speeding and red light offences, so for a red light offence the speed will be 0. 3 points and fine will result, the fine will be £100 if a fixed penalty is offered, |

I expect the NIP will arrive in the coming week but whenever it arrives it will be clearly over the 14 days. Does that invalidate penalty? No but it may give you a defence, but to do that you would have to refuse the offer of a course or a fixed penalty and take to to court. |

No defence there, and just too fast for a course so the fixed penalty is the best result you can get. You are not alone, many people are caught there. He says he was doing 37 in a 30. I thought a speed awareness course is available up to 42mph? (10%+9) It is...however OP has done a speed awareness course 2 years ago, so not available to them. |

Cancelling a DD is rarely a good thing to do, the Netflix and Spotify analogy isn't a good one as they don't use DD's as far as I know. To cancel them you have to do it through the app or account settings on line. |

Did the OP have 3 points at the time of the offence? This would explain a lack of FPN No it wouldn't, reaching 6 points in the first 2 years has no affect on whether a fixed penalty is offered. Revocation is purely an administrative process performed by the DVLA. |

I didn't spot the image link, so he has been lucky to be charged with the lesser offence of not being in control, so 3 points. If they had gone for using a mobile offence that would have been 6 points and a revoke. |

This is a 6 point offence, if he has only passed his test a year ago then as soon as the points are awarded, the DVLA will revoke his licence. If no course is offered, there is no legal right to have one. |

The speeding offence is way too old to be prosecuted. Name yourself as the driver and then completely ignore any offer of a course (unlikely) or fixed penalty, |

Not sure why people are getting hung up on the "direction", it isn't being used here (I strongly suspect) to indicate which way the vehicle was travelling, but to indicate the location is clockwise from J5 and before Clackett Lane Services. |
