Hi all,
My wife's car broke down so I gave my wife + kids a lift a few meters down a quiet road to our house. I already had some passengers in the car so my three year old daughter was sat on my wife's lap. Out of nowhere came two cops shouting away at me that I was getting points on my licence! I have now received an letter in the post: You have admitted to being the driver of motor at the time of alleged offence - Use a motor vehicle / trailer the number of passengers / manner carried likely to cause danger. You can choose one option: Complete a Whats Driving Us Scheme Course or Conditional offer of fixed penalty £100 and three points. The letter is addressed wrongly to: David (my surname, and my date of birth) but that is not my name! David is the registered keeper - A kind relative of mine who let me use his spare car during the pandemic as he did not need it. When the cop pulled me over he kept calling me David - as he was very young and was shouting in my face being overly dramatic I did not correct him as I assumed it would wind him up further. However when he went over my details I clearly informed him I was not David and gave him my correct name and date of birth. What do I do? |

When exactly were you stopped?
Also what outcome are you after? If you tell them the error and ask them to correct it you could likely get the course re-arranged in your own name. Well the person they are chasing isn’t guilty of any offence, if they continue on that route then no one can be convicted either.

I was stopped 07/10/2020 The letter is dated 09/11/2020 I have tried dealing with Greater Manchester Police re another case a few years back and they were a nightmare so I want to know my options before contacting them. I most certainly don't mind 'gaming the system'. - We have open drug dealing on our street and a few months back someone was shot. I have been burgled twice too - But there is never any police in sight and when we call them they always complain 'not enough resources'. But when I drive a few seconds down the very same road they suddenly have two motorway cops available to nick me! Well the person they are chasing isn’t guilty of any offence, if they continue on that route then no one can be convicted either. The person does not exist. It has my date of birth. My only worry is that if it does go to court they may get the correct name then. The videoed it all on a bodycam. The police kept asking me if I was going to dispute it. - I kept quite. |

OK to be clear (as it's not totally clear), are forename and surname both wrong? If only one is wrong, which one? Not helped by the fact that David can be used as forename or surname! My reading: the RK is David Keeper-surname. The driver is Driver-forename Driver-surname. The offer addressed to David Driver-Surname. Driver address. Driver DoB, but 'David' not the driver's forename. Op to confirm. |

Indeed. It has the wrong first name. All other details are correct. Thanks If all the other details are correct, I suggest you just tell them and get them to correct it. If you know it's for you, it has your address, your surname, your d.o.b. and you know the officer had got mixed up with your first name at the time, a court would probably say you know you're the intended recipient.
