Son received first a ticket on car saying wait till you hear through post. Then a s172 NiP arrived for the alleged offence of "Drive a vehicle when the registration mark fails to conform with regulations".
1, The vehicle was parked outside his house on xxx Avenue (the note on car and the Nip state xxx Road) The NiP is addressed correctly to the registered keeper at xxx Avenue 2, s172 requires the details of the driver at the time. (The vehicle was locked and parked) I was wondering if he should write a letter (after fourteen days) stating the vehicle was not on "xxx Road" and was not being driven at the time either. The plate was incorrectly spaced. Latest plate set out AA11 AAA Plate was set to A A11AAA. That seems less serious than making one character resemble another, so perhaps some chance of the matter being dropped. -------------------- |

Just a thought - a car can fail it's MOT for an illegally spaced / non-conformant numberplate (as it can for other modifications like illegal tints etc). So if the OP's Son's car is over 3yrs old, was it technically parked on a public road with no valid MOT? Or is the MOT valid from a year at the point in time it was issued, as long as a Cop does not take an interest in the vehicle and start to check it? If the MOT is invalidated by the illegal plate, then surely this opens up no insurance etc - i.e. a right can of worms. Apologies if I am barking up the wrong tree there. Agree with previous advice to the OP's Son - get a legal plate on the car & prove to the police you've done it and they may drop the matter. |

The MOT is only proof of compliance at the point of issue - it does not provide any subsequent proof of roadworthiness. (But it's not invalidated either)

We've had a fixed penalty rescinded after it had been paid in a similar case so it is not impossible to persuade the police not to pursue a case such as this, but you'd need to give us a bit more detail, such as what is wrong with the plate and how it came to be on the vehicle. The plate was incorrectly spaced. Latest plate set out AA11 AAA Plate was set to A A11AAA. OK, so how did the plate end up on the car? It probably won't .have come from the original dealer with an illegal number plate. Did you buy it yourself? Was it a gift from someone?
