Question on legality of what TW told me

Hi guys

Yesterday i parked outside a shop for a few seconds on double yellows and as i came out of the shop the TW was writing me a ticket, i said im going but she obviously wanted to give me the ticket so she took a pic and quickly carried on filling her form in. If she was decent she could have sene the car was running and i was a few yards away - only for a minute maximum but she didnt care.

I started to drive off and she said " if you dont let me give you this notice, you wont be able to appeal"

i said i dont believe you and drove off

My question is - is that true what she said and where could i check if its true or not?

Im expecting a fine coming soon and want to know about this point before i write back

You should get a postal PCN which you can appeal.

Hopefully it won't be a NTO (note to owner) which claims the PCN was served on you at the scene. You can appeal that too.

Do you own the car and is your name and address correct on the V5C vehicle log form.

What they said according to your narrative, can be taken in the context of you won't have the option of an informal challenge, but you can make representations (formal challenge) and then if rejected appeal to an adjudicator.

When you have a PCN post it here along with any council photos

It seems as though you may left the vehicle with the engine running. That is an offence in itself if so. Also being parked with the engine running can potentially give rise to a penalty in some areas (though I have no idea who actually enforces).

thanks for the reply, why do you hope its an NTO not PCN?

and yes i own it and am on the log book

i didnt know this, but as far as the council are concerned i think theyll be more concerned with the ticket/warden

Certainly the former is (I got done for it in about 1978, an endorsement an 30 quid iirc). Obviously beyond a CEO for any action

The latter though can get a fixed penalty under emissions regs (2003 ish).

Though from your response it doesn't sound like a CEO matter either.

Again, without checking, I believe that both of those were given to both Police and Councils to enforce. We had an example on here quite recently involving Hillingdon Council.

Is there anything we can suggest which provides a good ground for reps/appeal?

Cant see anywhere to view pics, do all councils let you do this?

ill take an up to date pic of the street tomorrow, it looks slightly different to the maps image.

What do i need to do now? im going to challenge it as i think she could have used her discretion and im not sure what she told me is true and also i honestly dont know if its a taxi rank or just DY. Also the link detailed on the parking ticket returns a page not found error. They should make sure their info is up to date
