Likely Ban - What next?, Speeding - exceed 70 mph motorway limit - on the M1

Hi,

I was stopped by an unmarked police car, with manned equipment to follow and check at 100- 110mph. I have pleaded guilty to the charge of:

Speeding - exceed 70 mph motorway limit - on the M1 -

As this is in between bandings, there is potential for a ban to be imposed. This will be impactful across all areas of my life including my work and family. I already have magistrates hearing date in place.

I'm not in a position to get legal advice, what do you suggest I do? Should I write a statement to the magistrates about mitigating reasons why I should not be banned? Any help or resources you are able to provide would be much appreciated.

If they are to ban you you'll be required to attend first, have you been asked to attend?

If you are in attendance there is no need to write, although it will be handy to have a prepared statement you can share.

There is strictly no 'hardship' defence to a ban for a one off offence, that is for 'totting' bans only, however they may well consider what you have to say.

For 100-110 a ban would be relatively short 2-4 weeks which most people can usually 'manage' with an understanding boss and taking some holiday.

OF course a ban is impactful, it's meant to be, how impactful you don't say.

Semantics on language, mitigation is what reduces the severity of the offence, your asking essentially for leniency.

I have asked to attend in person as this will carry more weight.

A ban isn't certain by any means. I have seen people doing 105 get 6 points and no ban.

A template would be a really really bad idea, the arguments should be personal.

Get a letter from your employer indicating what issues you being banned would cause them/or he'd have to dismiss you (if it's a factor), get evidence of why you can't commute by any other means for a few weeks.

Point out that 6 points on your licence would act as a constant reminder.... draw something up and post for critique, try to keep it to one or two short paragraphs.

Have you been required to attend (second time of asking)?

You most certainly cannot expect to not attend and get a good result as they won't be able to ask you questions to clarify any points.
