Hi all,
I am new here, so please go easy. Today, 3/10/2022, I received a PCN from Minster Baywatch stating I must pay £100 for breaching contractual terms. It was issued on 27/09/2022 for a contravention on 18/09/2022. It has taken 16 days to arrive, but is the rule only for the issue date to be within 14 days? I am the keeper of the vehicle. I cannot recall the contravention, but they use an ANPR camera on the only road in. What are my chances of getting away with it? Thank you This post has been edited by BanjoBob: Tue, 4 Oct 2022 - 12:04 |

Step one... Edit your post to not reveal who was driving. "The driver" parked and you'll deal with this as the keeper.
Let's see a copy of the notice you received. Both pages, personal details removed but everything else including dates and times left on. You'll need to use Imgur or similar to upload. Do you have any photos of the signage at the site? -------------------- Useful Links (for private parking charges):

They have 6 months to obtain keeper details and one month to get the pcn to that keeper ( the 14 days is a separate issue )
The £100 default daily tariff has been around for a decade and listed in the CoP , so very difficult to argue that it's "unfair" Post pictures as mentioned above |

We plan to visit again this week and look at the signs. One thing I do want to check is the name of the company on the sign. I don't recall it showing Minster Baywatch, but I will double-check. Thank you for your reply, I do appreciate it. BB This post has been edited by BanjoBob: Tue, 4 Oct 2022 - 12:06 |

The courts don't agree with your version of extortionate, you are wasting your time arguing against it , not until 2024 when government regulation kicks in
The claimant won't be interested in previous experience or payments etc, only this one alleged breach , but the fact that the driver has used the car park numerous times works against them because it's clear that they knew the terms on the signs , including the £100 default charge for any breach of contract The signs may say Bransby Wilson, a topic much discussed on here and over on mse parking forum, Minster baywatch being another entity |

You still need to edit your posts - there's a reason we're telling you not to reveal who was driving. From reading your posts it's currently clear who was driving...

I contacted the landowner, and their reply says that Minster Baywatch manages the car park. That contradicts what the sign at the meter says. Wouldn't any contract I agreed to be with Bransby Wilson and not Minster Baywatch?

Given there are signs for both any judge would have to decide who the contract was formed with (and any confusion should be interpreted to the benefit of the customer), I wouldn't say it's certain a judge would decide it was Branby Wilson, but probably better than 50%.

I will take those odds. Do I need to draft an appeal now? |

Correct , it's appeal or pay ( or try to obtain a landowner cancellation ) Please can you tell me if there are any appeal templates? The landowner is not showing any compassion. I read hundreds of complaints on Tripadvisor, and many received a reply from the landowner saying they were not interested. I think they gave up replying then! Yes there are , have a look for one that fits , after checking the NTK PCN for Pofa compliance, of not |
