Morning All

I have searched the forums but the majority of posts I can find for the terms I used relate to people passing through cameras on amber/red and being flashed.

For those who know it, I was travelling north west on the A56 towards Manchester city centre, at the junction of the A5145 (Kingsway), and I passed through a set of traffic lights on green doing 38mph in a 30mph zone. I did not notice a flash at the time but I have received a NIP in the post within the 14 day period. Google Maps link below:

The road is substantial, with three lanes in both directions, and I am certain I have been through the camera in excess of 30mph before. Nothing to be proud of, I know.

There is no signage as you approach it to suggest that the traffic light camera is also speed detection, although I am not sure whether there should be. In fact, despite driving the route every day, I had to check the location of the camera as I had no idea they could be dual purpose. The road has been undergoing works over the last couple of years which completed in recent months, and I think the camera has been activated fairly recently.

I have kept the post brief as I feel as though I may be bang to rights on this occasion, but if there is any further information I can provide which might assist please let me know. I just wanted to check whether there was any mitigation or grey area in respect of the dual purpose cameras which might help form a defence?

The fact that you did not know the camera would catch you speeding is neither mitigation nor a defence.

Enforcement begins at 35mph - you may have previously been under that.

Although the road is 'substantial' it doesn't change the fact that there's a system of streetlighting and no signs to the contrary thus making it a restricted road of 30mph. It looks like the limit was higher previously which would require the relevant order being revoked - this could be checked but is likely to be in order.

That excess will be a course offer or fixed penalty (3 points £100). I fear you have anything to challenge/mitigate.
