I received a parking charge notice as RK from Parking Eye yesterday for my car overstaying at a private car park in Newcastle. The car park apparently has a 1 hour free period with a notice saying there is no requirement to get a ticket of enter reg into a ticket machine.
The ticket shows the car entering the car park at 20:28 and leaving at 21:56. What it doesn't show is the car leaving the car park at 20:29 with the driver having realised they needed to go into the city centre to drop something off, and then the car returning at 21:15. Both photographs on the notice are accurate, but misleading due to the car having left and returned between those times. I realise this ANPR problem is common but I couldn't find specific advice for this shower of con artists. Any help will be much appreciated. |

Search DOUBLE DIP or similar
Appeal to them, poinitng out hteir system failed to record the exit at xxxx time and the re-entry at yyyy, and that this can be proiven in court if necessary> This would be via witness statement, google locaiton, reciepts, whatever you have NOW you preserve it. You expect them to cancel this without requiring you to go to the trouble of a POPLA appeal, but if they do vexatiously reject this appeal, you put them on notice that when you win at POPLa, you will claim your reasonable costs at £19 per hour from them. This is not the offer of a contract. |

Are there any 'no return within X hours' clause?

That isnt what hteyre claiming - just one long stay. So even if there were, theyve not made that assertion.

Fair point, but it might be the trigger even if the PCN doesn't make it clear. (More likely a simple double dip)

Post the appeal for critique before sending.
Personally I'd add and extra bit along the lines of Now that you are aware of the error made by your equipment you n longer have reasonable grounds to continue to process my data, as such please confirm that you have ceased processing it. failure to do so will be dealt with as a failure to comply with the data protection act and action taken accordingly. UPDATE!
Thanks to everyone for their advice. I added the paragraph The Rookie suggested and sent off the appeal. Yesterday I received a letter accepting the appeal and cancelling the charge. I also received an email from their 'Privacy Team' confirming that my data will be deleted. Result! |
