Morning All,
We've had a charge notice from Highview Parking for overstaying in the Crownhill Retail Park in Plymouth. They are claiming the driver stayed in the carpark for 7 hours and 8 minutes on the 4th May 2018. The claim is nonsense, it would have been multiple trips into the site. I can't remember the specifics of what happened that day but the missus would have used the car for the school run between these times, but i don't know how we can prove that? The cameras must have just missed the drivers exit on the first trip? I wish I had enough time in the day to sit in a carpark for 7 hours! Thanks for any help as always! Edit your post to remove identity of the driver. Simply refer to them as 'the driver'.
Did the driver meet or speak with anyone on the intervening trips? They could sign a witness statement. Does the other place visited have CCTV records? Was anything purchased anywhere using a card? At the end of the day, it's their word against yours, but the onus of proof is on them, not you. A statement that the car and driver were elsewhere ought to be enough unless they can prove otherwise, but supplementary evidence like I've described above will certainly strengthen your hand. I think there is a blunt example letter somewhere for a double dip (this is what they're called, and they are unusually common!), in which you can add that the registered keeper was not the driver at the time. -------------------- Sometimes I use big words I don't understand in an effort to make myself sound more photosynthesis.

Does the Missus have a mobile phone with Google Maps. Your Timeline would show the times of the full days movements on a map and with a full list of the places visit

Great thanks for that.
We've just found tracking data for the car too which proves it was elsewhere. Submitted our defense, hopefully they will go and bother someone else now! On another note while im here - we had a charge notice from Indigo Parking back in December which I appealed against with the help of you lovely people but I've heard nothing since. Do we get to a point where they have to give up because of time lapsed? |

On another note while im here - we had a charge notice from Indigo Parking back in December which I appealed against with the help of you lovely people but I've heard nothing since. Do we get to a point where they have to give up because of time lapsed? Six years |

On another note while im here - we had a charge notice from Indigo Parking back in December which I appealed against with the help of you lovely people but I've heard nothing since. Do we get to a point where they have to give up because of time lapsed? Depends on the type of Indigo ticket. Was the ticket in relation to an incident on railway land/car park? Did the ticket mention railway byelaws? If so, then there's a six month limit on bringing action in respect of a byelaw ticket. For standard car parks/spaces on private land it's six years. -------------------- Sometimes I use big words I don't understand in an effort to make myself sound more photosynthesis.

Ahh ok cheers. yeh no mention of railway byelaws it was in a hospital carpark.
