Hi guys,

I’m after some advise regarding a PCN received recently to the RK, can this be ignored or should I reply and if so which cause of action should I take?

It relates to a drop off at the express car park in Newcastle airport. The vehicle was used to drop off family and offload suitcases in which the vehicle would have been parked around 5 mins. The barrier that was entered was to the express car park but there was also a lane for vans/mini buses. The vehicle used was family vehicle larger than 7 seats.

Any advise would be much appreciated.

Many thanks,

T

Perfect, shall I send the below then, and then just awaiting the threatening debt letters to arrive, which of course will be ignored?

Sir/Madam,

Please can you answer the following:
Where this offense was proved and what the autoroute is derived from ?

Also as you are claiming you can levy a fine against me can you confirm you have authority from the Secretary of State?

When the alleged offence was proven? In which court, as this is only a job for the magistrates court
Who is liable for the offence, is it driver, keeper or owner

Where is THEIR authority to levy fines derived from? Who is this paid to, as all fines are paid to the Crown?

Is this a penalty, fine, or an offer to avoid prosecution?
A failure to respond will Allow me to draw the obvious conclusion

Did you receive a letter before action/claim?

You've left the VRM in the body text - and your password is still showing

Go online and acknowledge service - defend all, do not contest jurisdiction, do not put anything whatsoever in the defence box. - that gives you extra time to get the defence sorted.

Draft your defence and post here for the experts to comment

My wife has also received the same claim form from the county court business centre. the claimant is UK parking patrol office and the solicitor is BW Legal. It relates to an alleged offence on Newcastle Airport Roads, so it looks like they may be testing the water with a number of cases. I have already sent a defence back using a number of the points raised on the forum. I ham also considering complaining to the DVLA for releasing keeper information.

Except theyre allowed to do release keeepr information, so unless you can find a specific reason why the release was unlawful, good luck

Dont post in this thread, post a new thread, and it would be good to see your defence. Having not seen it, I would hate for it to be a terrible one...

These are the last letters I received before the claim form:

This was my last response to appeals via email in May last year:

2)Who is liable for the offence, is it driver, keeper or owner

Any reason you did not respond to the LBA, as you are obliged to do under the PAP?
That counts against you.

No, no one has bloody said that
I absolutely jump to the negative conclusion just because it was pointed out you ignored something you clearly had to respond to
