Marstons fine for no Insurance - no knowledge of it

Good evening all

Today I received a letter from marstons , for a fine . All it had was a code so I called them strait away
It turns out the Dvla took me to court in jan for “ keeping a vehicle without insurance “ - or words to that affect .. the women at marstons told me , but couldn’t tell me what vehicle

Now .... I am a motor trader - I am fully insured for any vehicle , for SDP and also test driving , I explained this and said I can’t help as I didn’t know the reg

It also turns out the dvla sent the court summons to an old address , so I take it it was for a vehicle I owned a long time ago !!

My question is : what can I do ? I knew nothing of this until today - I have sent in my insurance document to marstons clearly stating I am insured for anything

Also - does this carry points ?

I am at a loss here - I have no idea why they would send a court summons to my old address as all my vehicles are either filled out in trade and on my database , and my private vehicles are registered to my new addrsss

What you can do is perform statutory declaration that you were unaware of the court proceedings which will reset the clock back to the summons stage and allow you to then defend the allegation. Contact your local court and try and get details of the offence and then you can arrange to preform the SD either there or via a solicitor for a small fee.

This was heard in Sussex ! - I am in north London .. I have absolutely no clue about it - do I have to apply in Sussex it where I live ?

No, you can do it like locally. Arrange a date for the SD and then come back here and we can coach you in what to do 9n the day.

I have sent marstons my insurance - via email -... they said they will look at it and pass it into the court ... any chance it will be dismissed without me having to go to court ?

Cheers mate
I have an inkling it may be for a van sold a few years ago - hence old address but not sure ..

As I’m insured for absolutely anything am I required by law to add all my vehicles to the database?

If it was the van I did keep a copy of the v5 as I don’t trust the post

The van was registered to me ( trade slip sent off as was a trader exporting it )

I also have a transport business and those vans are unsure for H&R - the cars I sell are all insured under a trade policy I’ve held for years .

But I’ll wait and see if it is the van

Either you or your insurers do need to add all your vehicles to the MID, see guidance HERE.

It could be vehicle that has not been added to the MID, or a vehicle you have sold or scrapped that is still registered to you.

That’s what I’m thinking - although at this stage I have no idea what vehicle it was ... marstons couldn’t tell me , but they have suspended their actions for 21 days once I explained the situation .

Mening you really need to get thazt SD done.
That should get the DVLA to actually send some info.

Stat Dec applied for in July - also have details of the car and I have a sales receipt and a copy of the trade slip of the v5 ( I always keep copies ) - should be good enough I hope ... all I can think is it went missing in the post !
